September 4, 2019 PB Regular Meeting minutes
The September 4, 2019 meeting of the Point Pleasant Beach Planning Board opened at 7:00 pm. The Clerk read the notice of compliance with the "Open Public Meetings Act. Present were Board members: Mr. Ritchings, Chairman Ammirata, Vice Chair Russell, Councilman Migut, Mr. Babbini and Mr. Gant
Absent: Mr. Tighe, Mr. Bixby and Ms. Villani
Also, present Herschel Rose, attorney, Ray Savacool and Karen Mills, Clerk/Secretary
Motion by Councilman Migut, second by Mr. Ritchings to memorialize the minutes of April 3, 2019

Application 2019-410 – Remedios Guerrero Romero – 518 520 Arnold Avenue – Block 89; Lot 10; Applicant is requesting a change of use. Previously was a smoke shop – requesting to change to a deli.
Jilian McLeer, attorney for applicant. Exhibit A3 entered – Power Point Presentation – Jilian McLeer stated that present location is a vacant building which previously was a smoke shop. Applicant is requesting change of use to a Mexican Restaurant. Property owner has given consent for applicant to proceed with this application. Jilian McLeer reviewed business plan. Hours of operation will be 9am until 10pm. Approximately 5 employees per shift and deliveries will be 1 – 2 times per week. Proposing interior renovations – there will be no exterior renovation except the signage. Proposing tables and bar seating area. There are some pre-existing non-conformities associated with this site which will not be impacted by renovations. Master Plan does have a vision of a vibrant downtown area and we believe that this restaurant will add to that. Restaurant requires 7 parking spaces – does not have the ability to expand parking – the existing 7 parking spaces are shared with the neighboring restaurant.
Remedios (Remy) Guerrero Romero, applicant, sworn, stated he been in the restaurant business for 13 years in various businesses in town. Has the opportunity to start his own business with his brother. Will have a 6-burner stove, grill, fryer and broiler. Will have an area for people to sit and wait (bar stool type counter) Will have traditional Mexican food. Councilman suggested that he should have a student special since he is close to the high school. He will also have a warmer station for food that is being picked up. The restaurant will have 27 seats. Restaurant name will be Polito Loco (Crazy Chicken). Trash will be picked up by the town. The trash enclosure is located in the rear of the building.
The board was concerned with the exhaust pipe venting and its location to the existing apartments. Applicant will conform to any town fire code requirements.

Councilman Migut – This is a welcomed application since it broadens our selection of eclectic delights. I believe it will be a successful shop; there are several pre-existing non-conformities which I believe will not be impacted or effect the public good since they have been existing for at least 30 years. Not concerned with parking – I am sure people will find parking elsewhere on Arnold Avenue.
Mr. Ritchings – I concur with Councilman Migut
Motion by Mr. Ritchings, second by Councilman Migut to approve application #2019-410 – Remedios Guerrero Romero – 518 520 Arnold Avenue with conditions

Condition
- The vent for the grill area must be code compliant.
Administrative request – 2017-398 – Cincinnati Washington LP —Washington
Avenue – Block 16.02; Lots 10.01, 25 – 27 and 30 – 32 – Applicant wishes to amend a condition in reference to the garbage enclosure.
The board felt the that it is fine for the dumpster to remain in present location as long as the new enclosure is vinyl. The board does not favor the chain link fence with vinyl.
