October 2, 2019 PB Regular Meeting minutes
 
The October 2, 2019 meeting of the Point Pleasant Beach Planning Board opened at 7:00 pm.  The Clerk read the notice of compliance with the "Open Public Meetings Act.  Present were Board members: Mr. Ritchings, Mr. Tighe, Chairman Ammirata, Councilman Migut, Mr. Babbini, Mr. Bixby, Mr. Gant and Ms. Villani
Absent: Vice Chair Russell
 
Motion by Councilman Migut, second by Mr. Ritchings to memorialize the minutes of   September 4, 2019
 
In favor:  Ritchings, Migut, Babbini, Gant and Ammirata
Opposed:  None
 
 
 
 
Motion by Councilman Migut, second by Mr. Ritchings to Memorialize the action and vote approving application #2019-410 of Remedios Guerrero Romero – 518 520 Arnold Avenue – Block 89; Lot 10; Applicant is requesting a change of use. Previously was a smoke shop – requesting to change to a deli.

Administrative amendment request for resolution #2018-408 – Sarapochillo – 212 Channel Drive – Requesting to amend resolution to replace temporary plastic roll up windows with temporary hurricane proof glass windows.
 
John Jackson attorney for applicant reviewed the requested amendment by administrative approval. Original approval was for canvas/plastic roll down windows; applicant requesting to have that condition amended to sliding windows/doors that are hurricane resistant. Windows will be removed in warmer months.
 
Michael Sarapochillo, applicant, stated that business has been very busy; the wait for a table can be up to an hour. Lunch is also busy – deliveries start at 4am. They have also been involved with fund raising.   He didn’t realize that he couldn’t put in windows; he thought as long as they stayed in the foot print it was OK. The applicant was installing the windows when the neighbor called in a complaint and a stop work order was issued.  Michael Sarapochillo stated that he will remove the windows in the warmer months.  The windows will enable him to have a year-round restaurant business.
 
Pete Ritchings inquired if they will enclose on all three sides and have door. (Yes)The outside area will be code compliant with heating units.
 
Carolyn Villani stated that she was confused about a few things – slowly you have been encroaching and using the property not in the manner you came for. You also stated roll down canvas/ plastic drops for inclement weather. Now we have glass windows and a knee wall with heaters – way beyond original plan. I believe that you are opening Pandora’s box if you allow this to creep – you will have heaters and then air conditioners – she thinks that it is too much – he keeps inching and inching for more.  
 
John Jackson stated this is a wonderful success story – if it is open 365 days a year that it is fantastic.
 
Chairman Ammirata stated that the applicant said he will take them out in the summer – this will allow him to stay open in the winter and he believes the windows will look better. 
 
Mr. Bixby agrees with Ms. Villani but believe his businesses success is good for the town’s success.
Mr. Ritchings said he has been to many places with the window roll down – they are OK but when the wind and rain blows it goes right under. We are talking about extending the business season and I cannot think of a good reason not to do that – the upside is extending the season.

Motion by Mr. Ritchings, second by Councilman Migut to amend resolution #2018-408 of Larry and Michael Sarapochillo to allow for temporary seasonal windows.
