Acting Chair Mills called the October 13, 2020 meeting to order at 7:00 PM. Present were Board members: Mr. Bixby, Mr. Calderone, Mr. Cavagnaro, Mr. Woolley and Ms. Mills. The Board Clerk read the notice indicating compliance with the Open Public Meetings Act: “Adequate notice of the time and place of this meeting was given under the provisions of the Open Public Meetings Act and was posted and sent to the officially designated newspapers in compliance with the law.” Also published on the Borough web site.

Application #2020-414 – Thomas C. Abraham – 1209 Ocean Front; Tax Lot – 1 & 1.01 – Tax Block – 28.01 Zone SF -5
Applicant requests variances for minimum front yard setback for Washington and Ocean Avenue lot and for Ocean Front lot. Applicant requests relief for minimum rear yard setback and minimum side yard setback for both proposed lots.
John Jackson, Esquire reviewed the application and requested variances. Power Point Presentation entered as A-3 – Aerial view showed depicted property. Applicant owns both properties – Ocean Avenue dwelling is in the process of being sold. Believes that even with the subdivision that it will have the required parking requirements. The applicant has installed a fence on the proposed lot line so that perspective buyers could see the proposed property line.
John, Dziemian, Professional surveyor, credentials accepted. John Dziemian stated that the applicant wishes to move the property line 4.84 feet towards Ocean Avenue (West). Both lots were surveyed. Nothing besides the proposed lot line is to be changed. Lot 1 will increase to 9125 square feet and lot 1.01 will decrease to 5198 square feet. Parking will remain the same. Nothing besides the lot line is being changed. Subdivision will be perfected per deed.
John Mele, board engineer reviewed his engineering review letter. Requested the correct lot and block number be corrected along with some other noted specifics. John Mele reviewed the curbing, sidewalk and stone that needs to be updated/replaced. The applicant will repair and replace. John Jackson is requesting a mechanism in place to bond for curbing and sidewalks because the closing for the house is near. Document is to be provided from County Planning Board. Mr. Cavagnaro inquired since the Ocean Front home is a single-family home why there would be a need for three parking spaces. Mr. Cavagnaro clarified that the front lawn parking space is approved yearly and not a given.
Thomas C. Abraham, applicant, sworn stated he agrees to address the improvements to the curbs and sidewalk. Clarified that the fence shows the proposed new lot line. The applicant believes this will create separation between the two lots and gives the lots more conformity. The sale of this house has a contingency of receiving the sub-division. The applicant stated that the Ocean Avenue house has 4 bedrooms and the Ocean Front house has 5 bedrooms. Mr. Cavagnaro stated that he does not see a delineated parking space on the Ocean Avenue house.
John Mele stated that with a 5-bedroom house the RSIS requires 3 parking spaces – Ocean Front house is deficient in parking with only providing 2 parking spaces. Ocean Avenue meets RSIS requirements. Applicant stated he will install railroad ties to contain lawn stones. Railroad ties are to be removed on Washington Avenue and provide a cement curb.
Conditions
- The applicant is required to post all necessary site performance bonds, inspection fees and all professional review fees in accordance with the Ordinance.
- The Applicant will submit a revised site plan updated in accordance with the comments received by the Board’s Engineer in the letter dated October 2, 2020 and at the hearing on October 13, 2020.
- Applicant shall post a bond for the cost of the removal and replacement of the sidewalks along Ocean Avenue and some portions of Washington Avenue. The cost of the bond shall be determined by the Board’s Engineer.
- The Applicant will repair and replace the stone, sidewalk curb and driveway cut in accordance with the testimony received on October 13, 2020.
- The Applicant will submit a landscaping plan to the Board prior to memorialization detailing the proposed landscaping changes and installation of railroad ties along the sidewalk.
- The Applicant shall obtain certification from the Borough’s Tax Assessor that all taxes, municipal assessments and penalties are paid to date. The Applicant shall also provide a letter from the Tax Assessor approving the proposed lot numbers and street addresses.
- The Applicant shall perfect the proposed subdivision by way of filing a deed.
