MINUTES

The March 2, 2006 Special Meeting of the Point Pleasant Beach Board of Adjustment came to order at 7:35 pm. The clerk read the notice of compliance with the "Open Public Meetings Act." Present were Regular members: Mr. Simon, Mr. Cangelosi, Mr. Wolfersberger, Mr. Palisi, Mrs. Tooker Alternates: Mr. Leonard and Mr. Spader.

Motion by Mr. Wolfersberger, second by Mr. Cangelosi to memorialize the minutes of February 16, 2006 meeting.

Abstain: Palisi and Leonard

Motion by Mr. Wolfersberger, second by Mrs. Tooker to memorialize the action and vote approving application #2005-11 in the matter of Augustus Columbus Hayes Investment Group, 105 Baltimore with conditions.

Letter in reference to resolution #2003-29, Carl LaManna, 709-711 Arnold Avenue. Mr. LaManna is requesting that he be allowed to side the second floor with cedar impression siding instead of stucco. Palisi – I do not have an issue with cedar impression siding. More aesthetically pleasing. Cangelosi – request the resolution be changed. Wolfersberger – Would prefer cedar impressions.

Motion to approve minor modifications to application #2003-29, in the matter of Carl LaManna, 709-711 Arnold Avenue.

Application #2005-49, Richard Standt, 103 Elizabeth Avenue, Block 17.01, Lot 54; Applicant wishes to add 10 sq. feet to first floor of single family dwelling and extend second floor living space. Richard M. Standt, 441 East Main Street, Manasquan, sworn. Home was raised because the home had severe deterioration on the first floor. Going to build a new first floor and lower the second floor back down on top of it. Leonard: Why didn’t you just build a new home? Standt: I did not think the town would let me. The cost will be about the same to do it this way. Foundation raised 30 inches. Ceilings will be 9 feet. I will be changing the pitch on the roof to 9 feet. A-3 – Comparison board. A-4, Proposed foundation improvements. Cangelosi: What is total building coverage? Standt: Still under 30%. Reduced square footage of living space by 60 square feet and made it a more traditional layout. When I am done lot coverage will decrease from 49% TO 38%. Setback 19.7 now is 20.4, 14.3 is 13.8. That changed because I straightened the foundation. I will be using real cedar siding, not impressions. Hurricane grade windows, red cedar shingled roof with leaded copper standing seam roof over dormers. Total building coverage will be under 30%. Pulling up concrete and replacing with pavers to improve drainage. Finished height will be just less than 34 feet. There is a question on how the height of the home should be measured since there is no curb. Ray Savacool, Board Engineer will be contacted as to assure the home is being measured according to town regulations. Chimney comes out two feet from existing foundation; so the setback is 11.8 to 12 feet. Third floor balcony built into roof. It will have a fiberglass deck and you will be able to go out there and have a nice view; will not have view into neighbor’s home. Mr. Standt stated that the home would not affect the site triangle.

Deliberations:

Wolfersberger: I think we have gained a deminimus amount in setbacks. In visiting the home I noticed the home next door look massive next to this existing home. The home is not interfering with your neighbors, in favor of this application, as it exists.

Condition: 1.) Applicant is to build the home as described to the Board at the time of the hearing; including cedar siding, red cedar shingled roof and leaded standing seam roof over dormers.
2.) Home is not to exceed 35 feet in height as measured and confirmed by Board’s Engineer based upon the Borough’s benchmark.

Motion by Mr. Leonard, second by Mr. Wolfersberger to approve application #2005-49 with conditions.

Application #2005-46 – Richard Surgent, 1112 Marcia; Block 35.02; Lot 10; Applicant wishes to remove two-family home from lots 10 & 11 and construct two single- family homes (carried without notice) Richard Surgent, previously sworn. Landscaping Plan entered A-5. Richard Surgent is requesting that 3 feet be added to length of home. Dennis explained that he has to decide what he wants. Mr. Surgent explained that he would plant the height of vegetation and trees that is depicted in the landscaping plan. The pear tree will be between 14 and 17 feet. Mr. Palisi voiced his concern about modular homes and wants to be reassured of the heights of the bushes. Mr. Surgent commented that he is trying to keep the home affordable and Mr. Leonard replied that financials are not the Board’s concern. Mr. Surgent is requesting to not use cedar impression siding. His main purpose is to beautify the home. Mr. Palisi said there were very strong feelings about cedar impression siding.

Deliberations: Wolfersberger: I think the duplex is going to be an improvement; He addressed the landscaping. We gained on the setback. In essence we made one setback, which is unusual on a corner lot. I am looking forward to seeing the landscaping. In favor Leonard: I listened to the tape and it appears to me that you met one condition. I thought you were supposed to have cedar impressions. I am inclined not to be in favor. Cangelosi: I have to comment to Mr. Leonard that is a reasonable concern. I would prefer to see cedar impressions.

Conditions:
1.)Setbacks on Marcia will be 37 feet on one side and 19 on the other.
2.)Shudders as shown are to be added to windows.
3.)Applicant is to comply with the landscaping plan shown to the board as A-5. Planting height is to be determined by Board Engineer.
4.) Board allows applicant to add 3 additional feet to rear of home at time of construction, lot coverage is not to exceed 23%, in the event that the home is not constructed with the additional three feet the applicant will not have an entitlement to those three feet.

Motion by Mr. Wolfersberger, second by Mr. Spader to approve application #2005-46 with conditions.
