June 6, 2018 PM minutes
The June 6, 2018 Regular meeting of the Point Pleasant Beach Planning Board opened at 7:00 pm. The Clerk read the notice of compliance with the "Open Public Meetings Act. Present were Board members: Mr. Ritchings, Vice Chair Russell, Chairman Ammirata, Councilman Migut, Mr. Babbini, Mr. Bixby and Ms. Villani
Absent: Mr. Tighe and Mr. Gant
Also present Dennis Galvin, attorney, Ray Savacool, Engineer and Karen Mills, Clerk/Secretary
Motion by Mr. Babbini, second by Chairman Ammirata to memorialize the minutes of March 12, 2018.

Application #2018-406 – Bezmar, LLC – 506 Arnold Avenue – Lot 12; Block 89 – 500 – 502 Arnold – Lot 13 Block 89 – Applicant is applying for change of use/site plan with the addition of outdoor freezer box which is 8 feet by 16 feet and relocation of condensing units.
(The additional area owned by the diner is being added into the application)
Resolutions to be memorialized at end of meeting
Jillian McLeer, attorney for applicant, reviewed application and the proposal for the parking lot and the Amazon fruit Company; there will be no ovens or fryers. The proposed freezer will only slightly increase building coverage. Referenced prior resolution for paving of parking lot #2015-391.
Gregory Cox, professional architect/Planner, credentials accepted. Revised Engineering plan entered as exhibit A3. Referenced that the Acai restaurant will be located where there was a prior dress shop and reviewed the floor plan. There will be four tables and counter area. Greg Cox reviewed the signage. The new sign will be 26 square feet and will be lighted from the front to give it a handmade look. The façade treatment will be different. There will be no venting because it is frozen desert and fresh fruit. Building coverage will only be increased Bby1% and it will still be under 50% allowed. There are two 2- bedroom apartments located upstairs. Greg Cox reviewed parking requirement. Chairman Ammirata questioned the paving and the number of spots that will be available.
John Bezerra, Jr sworn, reviewed the issues with the parking lot and why it has not yet been paved. Another person owns a small portion of the lot and he has been trying to arrange to have the whole lot done at one time. John Bezerra has not been able to touch base with the other owner. Dennis Galvin commented that two years is a long time to try to contact someone. John Bezerra said the other person is interested but they never go forward. Carolyn Villani questioned if this is a problem since he hasn’t been able to solve this issue in two years- hypothetically you cannot do a plan using some else’s property. John Bezerra believes the other person does not want the expense. Carolyn Villani inquired which property belongs to the diner. John Bezerra stated he had a verbal agreement with the diner for parking but no longer wishes to continue the agreement.
Dennis Galvin reviewed the prior resolution on the parking lot and that it didn’t include the diner portion of the property and that the board routinely grants resolution extensions. There is a limit if they never build it and inquired when the applicant is going to pave the lot. John Bezerra stated that he will pave it in a month or two. Dennis Galvin recommended to the Board that they should attach a condition that f something changes with the neighbor that they can come back and revise the plan and resolution in the next 60 days. This way the neighbor can piggy back off this approval to expedite the process otherwise the neighbor will have to have his own application.
Audience questions/Comments
Macie McLoughlin (Diner tenant) – 212 Central Avenue – Owns diner – has spoken to John Bezerra and believes the paving is a good idea. That corner needs something nice. Has some concerns – because it is very hard to speak to her landlord. Celeste Miller is their attorney and has been trying to discuss the parking lot because of the deliveries. She is concerned she will have trouble with deliveries if the entire lot is not paved because some of them are semi-trucks. Dennis Galvin stated that the applicant can utilize their property if there is no agreement – that is why they are trying to get her landlord to comply. She explained that is how her garbage is picked up – Dennis Galvin said this issue is between her and her landlord – the next-door neighbor has been willing to cooperate for two years.

Deliberations
Council Migut is in favor of the change of use. Believes it is an upgrade to the existing site. The use will draw foot traffic from all over. Not concerned about parking.
Motion by Councilman Migut, second by Mr. Ritchings to approve application 2018-406 of Bezmar LLC with conditions

2015-391(2) – John Bezerra – 504 —–506 – Extension of resolution –
Motion by Councilman Migut to grant extension and also add the consideration to allow other property owner to send notice and piggy back on this application to pave his portion of the lot, second by Mr. Ritchings. The deadline for the extension is March 2, 2019.
