The December 5, 2018 Regular meeting of the Point Pleasant Beach Planning Board opened at 7:00 pm. The Clerk read the notice of compliance with the "Open Public Meetings Act. Present were Board members: Mr. Ritchings, Mr. Tighe, Vice-Chair Russell, Chairman Ammirata, Councilman Migut, Mr. Babbini Mr. Gant and Ms. Villani

Application #2018- 408 – Atlantic Fishery (Sarapochillo) – 212 Channel Drive Block 166: Lots: 4 & 5 – Applicant proposes to incorporate an outdoor enclosure for guest seating in front of building.
John Jackson attorney for applicant, reviewed application. John Jackson stated that this project is unique because the scallops/lobsters come right from the boat to the table. This business has been very successful so the applicant would like to add an outdoor awning to protect patrons from the weather and extend the season to November and be able to open in May. This greatly enhances the ambiance of Point Pleasant Beach and will be right up to the sidewalk. Stated there is right now a lot of parking on Channel Drive. Power Point Presentation entered as A-3. American roof motorized louver system. (Slide 6 – actual product) It is a sturdy and robust apparatus – will not blow down. Ray Savacool questioned that one is screen sided and one has plastic sides – and questioned if we know what the applicant is going with? John Jackson stated that the applicant will discuss – They applicant would like something that will roll down.
Jim Giordano, Professional Engineer, sworn, credentials accepted, explained the layout. He stated that the only difference from previous presentation is the addition of the canopy and the relocation of the handy-cap parking space. Variances requested – front yard setback is now zero. Also requesting parking variance for deficiency of 5 spaces. Councilman Migut questioned if it is good to have the canvas come down to the sidewalk – prefers a 6-inch setback. John Jackson said that they can do that. Carolyn Villani questioned if the roof line will extend the drop. (Yes) A-4 entered – google earth photo. Chairman Ammirata said the soffit will be 6 inches past the drop which will bring it to the sidewalk. John Jackson stated that they will pull it back.
Michael Sarapochillo, applicant, sworn, explained the overhang will be inside the boundary of 6-inches – referenced pergola design with lattice (slide 6) Motorized opening roof – not a permanent structure. Drop down should be well inside the post/footings. This design you do not need much pitch and you can open the roof in the summer. Carolyn Villani inquired what the pitch of the roof is? (at least 9 or 10 feet). Carolyn Villani clarified what type of window – they will be pin-up type windows. Michael Sarapochillo stated he is busy and the patrons need protection from the weather in Spring and Fall. Expects to be open from March until November – the retail is year-round. Mr. Gant inquired if they are going to enclose the whole thing. Mike Sarapochillo replied they are not 100% that hey are going to enclose the whole thing – right now moving in baby steps. Carolyn Villani clarified that they are temporary sides that you roll down – the sides are not permanent. Mike Sarapochillo stated that the pergola and sides are not permanent. Mike Sarapochillo stated that he would like to do a knee wall at some point. Carolyn Villani said you can also do a knee wall that also is not permanent.
Ray Savacool commented the awning creates a new side yard variance and they will need approval for that – questioned trash and storage. Mike Sarapochillo stated he will increase dumpster pick-up as needed – Right now it is picked up twice a week.
Kerry Morgan clarified that they will retain the indoor seating. (Yes)John Jackson stated that the application is for indoor and outdoor seating for a total of 48 seats.

Deliberations
Councilman Migut believes the application is welcomed to Point Pleasant Beach – it is exciting to hear a new business is thriving in an area where the town is in need of revitalization. Many of the non-conformities are currently existing and believes the variances can be granted without harm to the public or the Master Plan. Believes there is adequate on street metered parking which the town would like to see utilized.
Ms. Villani – questioned if the knee wall needs to be approved now – you might as well incorporate it now – the know wall would really dress it up.
Ray Savacool said the Board should provide direction so they get what they want. The aesthetics can be approved prior to memorialization.
Conditions
- To be setback 6 inches from sidewalk.
- Height of roof to be minimum of 9 feet.
- Front yard setback of six (6) inches; side yard setback of 5.03 to match building and 5 10 parking spaces where 15 spaces are required.
- Knee wall should match setback and be no higher than 3-feet – is subject to Board Engineer review.
