Council Meeting Minutes

             Mayor Reid called the meeting to order at 7:31PM. Present were Councilmen Vogel, Cortes, Kanitra and Migut. Councilman Santanello was absent. The Municipal Clerk read the notice indicating compliance with the Open Public Meetings Act: “Adequate notice of the time and place of this meeting was given under the provisions of the Open Public Meetings Act and was posted and sent to the officially designated newspapers in compliance with the law.”

            Motion by Councilman Migut to approve the October 2, 2018 Council meeting minutes was seconded by Councilman Toohey and carried by roll call vote.

PROCLAMATION:  
 
            Mayor Reid: presented a proclamation, recognizing National Friends of Libraries Week, to Friends of the Point Pleasant Beach branch of the Ocean County Library’s Manager, Matt Willbergh, and Treasurer, Joe Zisa. Mr. Willbergh noted recent building renovations including a new roof, new deck, painting and updating wiring, with more to be done.
DEPARTMENT HEAD MEMOS: 
            Councilman Cortes discussed ZO Petrillo’s memos regarding the following curb cut requests: 119 Central – agrees with 13' cut and tree replacement, per Board of Adjustment (ADDED AS 1V); 115 Washington – agrees with 13' cut and removal of spot on Baltimore (ADDED AS 1W); 505 St. Louis – agrees with two 13' cuts (ADDED AS 1X); 598 St. Louis – agrees with keeping current cut, with delineated driveway [Councilman Vogel: suggested a 60-day timeframe to delineate with railroad ties; Attorney McLean: that's reasonable; (ADDED AS 1Y)]; Councilman Vogel: first two are in advanced construction – coming to Council late in the process; Councilman Toohey: ZO Petrillo provides letters to be signed – should maybe have signed copy for agenda) builders might be signing – asked Councilman Migut to follow up (Councilman Vogel: 598 St. Louis has 2 cuts on one property – need to be mindful of reliefs granted in perpetuity with no follow-up – situations might have changed) sometimes there are single properties on double lots (Mayor Reid: asked Councilman Vogel to meet with ZO Petrillo; Councilman Toohey: can mandate any of this by ordinance).
 
COMMITTEE REPORTS:
 
            Councilman Vogel: Intercoastal Tug of War is this weekend, with other associated events; food truck event is in Borden's lot next weekend with music and entertainment; American Legion will dedicate a monument at the Veterans Day ceremony, November 12th, at Veterans Park.
 
            Councilman Cortes: pointed out the personnel items and grant application on the agenda; Little Silver Lake shoreline plantings are underway; Albert Marine is working on the Boston Ave. tide gates – should take about 2 weeks; vegetation outside Borough Hall is being removed to address the leak; Loughran’s Point is moving along; worked on the back of the recycling truck with Councilman Kanitra yesterday – DPW should not be taken for granted – not easy – do a great job; Beautification Committee’s butterfly garden will not be disturbed by directional drilling, except for maybe a couple of shrubs – they would like a representative there; Boston Ave. garden was destroyed by Albert Marine’s machines – per BA/CFO Riehl and Engineer Savacool – Albert Marine will make it whole; on behalf of Councilman Santanello, gave the Police report since the last Council meeting – training included Canine In Service, SWAT, Internal Affairs Investigators and Spillman Administration – Making Strides Against Breast Cancer Walk is October 21st – Capt. Duffy is handling the planning – expect 20,000 participants – traffic could be hectic with bridge work – Department offers daily house checks for vacationers; for quality of life, asked that the Attorney be authorized to review/amend/draft an abandoned/derelict property ordinance with defined fee scales, using Paterson’s, Montclair’s, Toms River’s and Jackson’s ordinance wording (Councilman Toohey: might be an opportunity to do a package of ordinances; ADDED AS 1Z).
 
            Councilman Kanitra: went out with Code Enforcement yesterday – noticed overcrowding in certain homes – ZO Petrillo has been extremely responsive and proactive – some houses will be summoned for overpopulation – lot of landlords don't live in town, don’t have a vested interest and are repeat offenders – suggested a severe punishment, as part of the package of quality of life ordinances; has spoken to Assembly offices about a bill for next session to tackle the issue of irresponsible bidders; will be on 105.7 The Hawk’s Tug of War team – disappointed that Councils are not competing; Brick will be charging different beach rates for non-residents – has to do with Green Acres (Councilman Vogel: PPB leases the beach; BA/CFO Riehl: 3-year contract was just renewed) he will research; spent eye opening time on the recycling truck – bins are cracked and leaking (Councilman Cortes: downtown dual bins are banged up) should have a standard bin to recommended to residents (Councilman Cortes: 44-gallon is the limit by ordinance – there were some 96-gallon bins) need to better inform people on what can be recycled; majority of lights around town are fixed and Parkway is ready to go – will be an 8-9 day process, starting after the Making Strides Walk – have submitted a lighting survey to turn some lights over to LEDs.
           
            Councilman Toohey: the Loughran's Point Park equipment and gazebo were delivered and will be installed in about 2 weeks; Eastern Surfing Association contest is October 20th on Maryland Ave.; Boston Ave. drain work is underway – should keep an eye on the Lake Louise bulkhead, with that many tons of equipment on top; asked Chief Michigan if traffic will be diverted from Rte. 34 to the Rte. 70 bridge during the Making Strides Walk (Chief Michigan: a warning signboard is out) thanked him for work this summer and on the Walk (Councilman Toohey stepped out 8:08-8:12PM).
 
            Councilman Migut: complained about bike pub tours – asked Chief Michigan to adopt a policy of casual dissuasion and to keep an eye on them; proposed authorization for Attorney to draft ordinance setting an Airbnb tax at 3% (ADDED AS 1AA) – should take advantage of this now permissible revenue stream (Mayor Reid: doesn’t like to be taxing people – can discuss).
 
            Mayor Reid: Tug of War is on Saturday, 11AM-4PM, with food, adult beverages and music – Councilman Cortes will lead the event from the PPB side – great day; Sunday is the Making Strides Walk – great weekend in PPB; Loughran’s Point is looking better and better – putting water line in today; explained the STAND walk on the agenda.
 
            BA/CFO Riehl: Loughran’s Point playground and gazebo came today –ordered new plaques and hired a guy to clean the existing one – on schedule (Mayor Reid: there is a guardrail around the playground); recycling letter went out to businesses, giving them until November 15th to submit survey (Councilman Kanitra: will help to get more tonnage money; Councilman Cortes: residents need to help out); received $5,800 quote from JCP&L for removal of transformer at Cooks property – asked Councilman Cortes if he wants to authorize an order tonight (Councilman Cortes: yes; Mayor Reid: been working on this for years; ADDED AS 1BB); St. Louis road work will begin October 29th and end in December – contractor will notify homeowners and businesses at least 48 hours in advance – Phase II, next year, will address the Washington/St. Louis issue; contractor will install handicap spots, authorized last meeting, by St. Peter’s (Mayor Reid: make sure they reach out to neighbors); met with Engineer Savacool and Enviroscapes about a Lake of the Lillies planting plan – replacing dead trees and lowering water elevation – sprayed a couple of weeks ago – vegetation will be cut a week after trees are planted – in spring, shrubs will be pulled and flowering plants put in to alleviate the height issue – grant application to study/clean the lake was submitted in August and is under review; there was a dune project partnering meeting today – outfall to be completed by end of December – scheduled to start dunes in April 2019 (Councilman Kanitra; per Engineer Savacool, fines for liquid damages have been bumped up significantly for future contracts).
 
            The Municipal Clerk announced additions to the agenda.

                     Ordinance 2018-19 (Amend Invasive Plant Ordinance) was considered on second reading. Mayor Reid opened the public hearing. Motion by Councilman Vogel to close the public hearing and adopt Ordinance 2018-19 was seconded by Councilman Migut and carried by roll call vote.
