executive session by motion at the public meeting.
 
Council President Vogel called the regular meeting to order at approximately 7:34PM. Present were Councilmen Vogel, Cortes, Kanitra, Migut and Santanello. Mayor Reid and Councilman Toohey were absent. The Municipal Clerk read the notice indicating compliance with the Open Public Meetings Act: “Adequate notice of the time and place of this meeting was given under the provisions of the Open Public Meetings Act and was posted and sent to the officially designated newspapers in compliance with the law.”

Motion by Councilman Cortes to approve the October 15, 2019 Council meeting minutes was seconded by Councilman Migut and carried by roll call vote.

PROCLAMATIONS: 
 
Councilman Vogel presented proclamations to the following PPB Student Athletes:
Braden Ryan, Point Pleasant Beach High School Sophomore, was recognized as a member of the two-time defending Shore Conference Champion Point Pleasant Beach-Manasquan Ice Hockey Co-Op Program, a Brick Stars Challenger Program volunteer, and member of the Brick Hockey Club in which he scored his 100th New Jersey Youth Hockey League goal.
Quinn Heanue, G. Harold Antrim Elementary School sixth-grader, was recognized as a member of the Brick Hockey Club, the Manalapan Cannons and Parker’s Army hockey teams and the first Point Pleasant Beach player to be selected to the Philadelphia Phantom team for the 2020 Quebec International PeeWee Hockey Tournament, representing USA Hockey’s Atlantic Division.
Alex DePalma, PPB resident, Coaching Director of the Brick Hockey Club, Coach of the Brick Stars Challenger Program & Special Hockey Coach Director for Atlantic Region-USA Hockey, spoke about the boys and the programs.
 
DISCUSSION:  Best Practices Worksheet
 
BA/CFO Riehl: explained that the completed worksheet (which was provided to the Governing Body prior to the meeting) is required to be submitted to the DCA annually – it is scored on “no” answers versus “yes” answers – 34 or 35 additional questions were added this year, which did not affect the overall score – if a municipality has less than 30 “yes” answers, 5% of the December State Aid payment will be withheld – PPB had 38 “yeses” out of 84 questions – some repetitive and some new – 1 or 2 were marked “prospective” and can be changed for next year (Councilman Migut: one question marked  “prospective” is ‘Does your municipality have cyber security incident response plan?” – pointed out that Councilmember-Elect Vitale's job is cyber security – will be answering “yes” to that next year) that was a new question this year and they are looking for towns to have a written policy – PPB has the JIF guidelines, but they want towns to have their own – can work on that for next year (Councilman Cortes: one question is about electric car parking – Manasquan has 2 with a 2-hour minimum and payment which is similar to paying for air at a gas station – will do some research; Councilman Kanitra: the State has grant opportunities for 2 spots per municipality so maybe that’s something to look into applying for) that was a non-point question – another such question was about trash collection 1 day/week, which doesn’t work for a lot of towns,  like PPB – they are just trying to get information from around the State – survey had to be filed by the 30th but is required to be on a Council agenda for discussion and passed by resolution – have never fallen below the required “yeses.”
 
COMMITTEE REPORTS:
 
Councilman Vogel:  met with School Super. Smith, School Resource Officer, Chief Michigan and Det. Meany regarding lessons learned from the incident at Brick High School – good dialogue – in much better shape with communications than other towns; Ladies Night is November 14th, Christmas Tree Lighting is November 29th, rain date is the 30th –  will be a special presentation from Wreaths Across America; suggested a Locks of Love installation – if Arts Committee has something, will take a look at it – there is a space along the Inlet parking area, across from the Municipal bathroom, where something can be installed – suggested fencing with maybe a heart or some local branding (Councilman Migut: spoke with Councilman Kanitra about approaching Ocean County Vocational School to sculpt something) would welcome other ideas – locks were removed when the fence was replaced – there has been additional removal and some addition of locks – need something sooner rather than later – Chamber is interested in supporting – need about $550.00 to install it and make it ADA accessible – doesn’t obscure the line of sight to the Inlet – anticipates it would be about 28 feet – asked about putting it on a consent resolution or at least discussing it – a lot of local groundswell – don't need a committee to get something up there in the interim and incorporate into a permanent long-term solution – no objection to motion by Councilman Vogel, second by Councilman Santanello to add appropriation of $550.00 for a Locks of Love fence as Resolution 4; saw an umpire getting dressed in the Post Office parking lot, along with other parking issues; has done more research on Kratom, if anyone would like to move forward – would vote positively on second reading for that ban.
Councilman Cortes: congratulated Councilman Kanitra and his running mates; recognized November employee anniversaries – Mike Ormsby 30 years, Jennifer Coyne 14; sat in on Zoning/Code Enforcement interviews, as ZO Petrillo is retiring at year-end/item 2g – very qualified – will train with ZO Petrillo for a month; NJ Transit completed Washington Ave. grade crossing and is finishing New Jersey Ave.; train station is in disrepair – wants to reach out to NJ Transit to fix the concrete stairs and broken glass and clean it up (Councilman Kanitra: residents think the area by Osprey is overgrown too; BA/CFO Riehl: have emailed them about Osprey; Councilman Kanitra: asked that it be included in request); NJNG project is ongoing; Ocean County is still working on the Broadway Bridge and work is being done on the Brielle Bridge; Earle has mobilized on St. Louis Ave. by Philadelphia with their storm drain pipe crew; electrician replaced all the bad GFI outlets on the green light poles downtown and DPW installed nice new LED snowflakes on the north side of Arnold Ave. – trees need to be cut on the south side, as snowflakes might not be seen; Beautification Scarecrow Contest had 13 entries from Antrim School – Beautification will coordinate putting garland on the poles and he will coordinate putting up the swag lights with the newer used bucket truck.
 
Councilman Kanitra: thanked residents for humbling election results – looking forward to his new role in January; Arts Gala is March 21st at The White Sands – more than 200 people came to the last one and raised a ton of money for the arts in PPB – an incredible evening – encouraged all to support – will be a flash mob at the Tree Lighting – sign up on pointbeacharts.com – will be a cardboard snowman decorating competition this year with information on the web site in a week or so; he,  Councilman Cortes, BA/CFO Riehl and Engineer Savacool met with Earle Paving & Construction – commended Earle, whose president reached out to him and Councilman Cortes to arrange the meeting to discuss the displeasure with some of their previous projects – St. Louis Ave. is coming up – they were the low bidder and they assured that the job would be done right and residents would get good value – thanked all who attended; attended the Downtown NJ Conference, which was eye opening – will be self-parking cars in 10 years and automated cars thereafter, requiring less parking; attended the Save Barnegat Bay Conference – PPB was recognized for winning a $30K underground infrastructure grant – reached out to Pt. Boro, who purchased a truck to look underground – has spoken to BA/CFO Riehl about how to stretch the $30K and be proactive about what is going on underground; is a fan of the show Jersey Shore but never wants them to come back – they filmed in a house in PPB – train wreck television – not the image or type of tourists PPB wants to encourage – wants to ensure they are never issued permits to film in town again; are looking at a big expenditure for a dog park and corresponding parking lot that could well exceed the budget – encouraged residents, looking for a place to take their dogs, to register them for the goose patrol; a demolition permit has been requested for the Gottlieb building – one of the most historic and beautiful downtown – can be a centerpiece for downtown revitalization – encouraged residents to educate themselves – depending when the permit is issued, the building could be gone in a week or two – is adamantly opposed to it.
 
Councilman Migut: congratulated Mayor-Elect Kanitra and Councilpersons-Elect Vitale and Testa – looks forward to working with them in January; congratulated the Arts Committee on their beautiful PPB mural; asked BA/CFO Riehl about water meter delinquencies (BA/CFO Riehl: just a handful of non-responses); Animal Welfare Committee fundraiser at the Last Wave Brewery was successful – thanked Joe Leone’s and all who donated; Planning Board approved a 3-lot subdivision on Trenton Ave. – next month, the Board will hear an application on the amended Wine World site plan, as ZO Petrillo discovered that a plumber has been operating out of their basement.
 
Councilman Santanello: recognized all Veterans for their sacrifices and our freedoms, especially Chief Michigan, a Marine Corp. Vet; Tug of War is bringing in about $20K –  improvements to be made next year – a roaring success and PPB won; Rec Basketball had signups and is gathering teams – appointments and rates are on the agenda as item 1o; spoke about item 2g – interviewed about 6 people with a variety of experiences and abilities – this candidate stood out with a good, but tough,  personality – wrote her mother a citation as a Code Enforcement Officer in another town – ZO Petrillo will be a big loss, but she'll fill in well; recent Police training included SWAT, Canine and Report Writing – there were various arrests and summonses issued – Officers are participating in No Shave November to raise funds for men’s health issues – PBA Local 106 will donate money raised to the Cancer Care Center at Ocean Medical Center in Brick – more information is on the PBA 106 Facebook page – hiring 35 Class II Special Law Enforcement Officers for the summer – they are entering the Police Academy on December 2nd – on behalf of the Chief, thanked Lt. Kowalewski for coordinating the new hires – participating in Drive Sober or Get Pulled Over Statewide DWI Campaign – on behalf of the Department, wished all a Safe & Happy Thanksgiving.
BA/CFO Riehl: clarified that PPB did not issue a permit to Snookie – might have to tweak the ordinance, as they were on private property (Councilman Kanitra: they have to cross public property; Chief Michigan: shares the sentiment – has never approved them); issued an RFP for Architectural Services for the proposed building at Seacoast Oil – about 25 people picked up RFPs – received 6 or 7 responses – need to evaluate how to proceed; tax sale is November 22nd at 10AM (Councilman Cortes: asked if the Maryland Ave. bids will be revamped) yes, but there is no time this year –  the low bid for Maryland Ave. and Delaware Ave. repairs was $100K over budget.
 
Councilman Vogel: the 2014 Special Event ordinance repealed one passed in 2013 and wasn’t codified correctly – went back to the drawing board with some revisions – original pertained to public property/use of municipal services – there are things pertaining to First Amendment rights, etc. that should have been included – original 2003 ordinance hadn’t been amended – is being revamped and will be introduced next meeting – Atty. Zabarsky’s office has been working diligently – wanted a chance to review it in detail, so it will be 100% accurate.
 
PULIC PARTICIPATION BEGAN AT 8:19PM
 
Dave Cavagnaro, PPB: congratulated Mayor-Elect Kanitra and Councilpersons-Elect Vitale and Testa; asked about items 1u and 2c; regarding Ordinance 2019-17, asked about permits for park use, about a Police patrol schedule, the definition of adult and maintenance costs.
Marilyn Burke, PPB:  congratulated the newly-elected; asked about 1i, the bid process, and 2e; asked how many skaters would be allowed in the park at once, how much of a cost savings the Co-Op would provide PPB and if the construction company's bid is flexible.
Donnamaria Adelizzi-Diaz, PPB: congratulated the newly-elected; asked about skate park square footage, the number of skaters permitted at one time, security cameras, responsibility for maintenance, required training, permits with liability waivers, how the Post Office feels and if the Little League bathrooms will be available for skaters.

Councilman Vogel: concerned about locks at the Inlet T – suggested a fundraiser and something on an interim basis – seems like a low-cost solution – can be branded – Arts Committee can tweak it (Councilman Kanitra: likes the idea of something artistic – doesn't want something cheap – seems like a waste of $550.00 for something that will hold a ton of locks – will rust and look like garbage – short-sighted – not a bad idea, just needs to be done right – would vote to authorize the Arts Committee to start looking at something).
Motion by Councilman Cortes to HOLD RESOLUTION 4: Appropriation of $550.00 for a Locks of Love fence, to investigate other ideas, was seconded by Councilman Migut and carried by roll call vote.

ORDINANCE:
 
            Motion by Councilman Kanitra to amend Ordinance 2019-17 to include permit access, like  Pt. Boro’s, and restricted numbers based on statute (Attorney Zabarsky: suggested amending to include a maximum occupancy number, which he will get from Spohn Ranch – wouldn't put a number on it now – will do due diligence to find out what the number should be; Councilman Vogel: suggested maximum users to be set in accordance with the manufacturer’s or JIF’s guidelines; Councilman Cortes: Pt. Boro has a paid Rec Coordinator to handle permits) asked if permits would be overly burdensome (BA/CFO Riehl: questioned the purpose, as no one will be there to check them; Councilman Vogel: no permits are required for basketball, which has higher injuries, statistically). Motion was rescinded.
Ordinance 2019-17 (Amend Ch. 3 – Create Skateboard Park) was introduced on first reading. Motion by Councilman Cortes to approve Ordinance 2019-17, as amended to include verbiage that a maximum number of users be set in accordance with manufacturer or JIF guidelines, was seconded by Councilman Santanello and carried by roll call vote. Public hearing will be held December 3, 2019.

Bob Maloney, PPB: asked about the cell tower at Little Silver Lake coming down (BA/CFO Riehl: they have until November 30th).
Dave Cavagnaro, PPB: asked about dune grasses and about brighter lights on Parkway.
Anthony Andretta, PPB: asked how the skate park capacity limit would be enforced; complained about the state of the bathrooms at Pleasure Park.
