Council Meeting Minutes
Mayor Reid called the meeting to order at 7PM. Present were Councilmen Cortes Kanitra, Toohey, Migut and Santanello. Councilman Vogel arrived at 7:45PM. The Municipal Clerk read the notice indicating compliance with the Open Public Meetings Act: “Adequate notice of the time and place of this meeting was given under the provisions of the Open Public Meetings Act and was posted and sent to the officially designated newspapers in compliance with the law.”
The Municipal Clerk read the Resolution for Executive Session: “Whereas, Section 8 of the Open Public Meetings Act permits the exclusion of the public from a meeting in certain circumstances; and whereas, this governing body is of the opinion that such circumstances presently exist, now, therefore, be it resolved by the Mayor and Council of the Borough of Point Pleasant Beach, County of Ocean and State of NJ, as follows: the public shall be excluded from discussions concerning the hereinafter specified subject matter; the general nature of the subject matter discussed is as follows: one personnel matter and one litigation matter. It is anticipated that the subject matter discussed may be made public upon its conclusion or final disposition.” Motion by Councilman Cortes to enter Executive Session was seconded by Councilman Santanello and carried by roll call vote. The Governing Body reserves its right to amend and supplement the purposes of executive session by motion at the public meeting.

COMMITTEE REPORTS:
Councilman Cortes: reported on Beautification Committee activities – flowers were delivered – garden plantings for boat weekend are looking good – recycling center employee, Colette Betz, has planted flowers – looks good – drop-off will be closed Friday and Saturday and open Wednesday (due to boat race events); spoke to Bob Albert from Albert Marine – dredging will be complete by May 23rd, if not sooner – an issue at Lake Louise was promptly taken care of – a storm drain was found to have phragmite roots in it – Engineer Savacool asked Albert Marine to clean that out (BA/CFO Riehl: outfall from Liberty Ln. to the lake was under water – DPW Super. Trout was in the lake and found the outfall – Albert Marine excavated it and, within minutes, Liberty Ln. was clear) Bay/Laurel and Little League lots were paved and lined – line painting contractors are out – slow progress on Parkway (Councilman Vogel arrived; BA/CFO Riehl: have asked for permission to start work at 6AM on May 25th to be finished that day) a sink hole at the Chicago/Arnold intersection was timely repaired by the contractor – kudos to all involved including the police, DPW and Water Dept.; Food Shack is open at the bath house.
Councilman Vogel: provided feedback from the last Chamber meeting – asked for brighter street lights on Bay between Arnold and Laurel (Councilman Kanitra: will bring it up at talk next week) concerned with pedestrian traffic safety at Arnold & Bay – should reach out to the County for signage.
Councilman Kanitra: Environmental Commission is working toward Bronze Certification in the Sustainable Jersey program – the Green Team is actively working to obtain credits; all are happy with the cigarette urns – was able to have the price dropped by about $1,100.00; thanked BA/CFO Riehl for the quick work on Liberty Ln. – thanked Chief Michigan for having Police locate an abandoned car that was reported through the Report It app – the app has already had really good usage – more communication with residents is a good thing (BA/CFO Riehl: has responded to those reports that were directed towards the Mayor) asked for a County update on the flooding at St. Louis & Washington (BA/CFO Riehl: Kiely was doing the work for the utilities and wouldn’t address it) asked for options and what he can do to help (Councilman Cortes: will ask Engineer Savacool to contact the County; Councilman Toohey: asked how the Borough can go about fixing a County road; Attorney Riordan: could ask for a permit; Councilman Migut: Engineer Savacool mentioned a storm drain shortage at the east side of St. Louis) BA/CFO Riehl and DPW Super. Trout mentioned that some street ends aren’t as neat as the should be – Environmental Commission volunteers have been tasked with some of these street ends – asked BA/CFO Riehl to call for additional volunteers on Facebook (Mayor Reid: has about 20 people from a bank who want to come to PPB to work – the same group who painted the buildings) it entails ongoing maintenance but might be good for a one-day project; meeting with Engineer Savacool & JCP&L this week or next to finalize LED light submittal – Chief Miles relayed concerned about plantings in the parking lot – must stay low so, as not to impede the sight of residents and fire truck drivers; there are great volunteers for the Cultural Arts Committee – welcomed all to the first meeting on the 22nd – planning a Mayor & Council’s art gala/fundraiser in the fall – brought up Gerrie Vergona, who will be Chairwoman, for introduction.
Geraldine Vergona, PPB: spoke about her current projects and background (Mayor Reid: invited her to be the next Artist of the Month).
Councilman Toohey: asked BA/CFO Riehl about the Inlet bid (BA/CFO Riehl: met last Thursday – proposed gazebo must be scaled back – had final walkthrough on the Inlet Bulkhead project – ACOE was there – came in under budget, so might get some money back – asked if Council is interested in funding a continued splash pad) a rail will be needed – asked her for the drawing (BA/CFO Riehl: will also ask for an estimate) wants to go out to bid and get it done; after the events in Florida, he and Councilman Vogel met with the School Superintendent and Business Administrator – asked for the status of the School Resource Officer (Councilman Vogel: spoke to Dr. Savage – still waiting on something from their legal counsel); spoke to Coach Wagner and PPB Wrestling Team members about a program to expose kids to the sport of wrestling – 1 day/week this summer and a couple nights through the winter season – he, Bill Ammirata and PPBHS wrestling staff member will help – about 10 kids under the age of 9 are already interested – probably Wednesday nights – under the auspices of the Recreation Committee – use of facilities will be approved at the Bd. of Ed. – will consider at the June Recreation meeting.
Councilman Migut: Planning Board heard an application for a retail lobster shop on Channel Drive a while back – while under construction, the Building Dept. determined that the lobster tank cooling mechanism required modification – was an issue with a neighboring hotel – all worked out and construction will resume – should open late June – will be nice.
Councilman Santanello: will present the Recreation wrestling program plan at the committee’s June meeting; gave Police report since last meeting – training included Canine In Service for Patrol & Scent Work and SWAT – Police activity included motor vehicle summonses, arrests for possession of controlled dangerous substance, disorderly conduct, contempt of court and DWI – current community policing programs include Click It or Ticket national mobilization and 7-Eleven Operation Chill – SLEOs graduate on Thursday and their first day on the job is May 18th, in time for Powerboat Weekend activities – it is National Police Week, honoring all fallen officers who were killed in the line of duty – 135 in 2017 and 53 so far in 2018.
Mayor Reid: all are doing an amazing job; DPW and Police are ready for the upcoming boat race – will be at the Wharfside Patio on Thursday night, raising money for the local Hudanish Foundation, which provides education on drug use – 30-40 boats are coming to downtown PPB on Friday – Saturday is the Racers Village at the railroad lot with a parade at 5PM – PPBHS Band will lead the parade – race starts at 12PM on Sunday – excited for the summer kick off; wants a No Nodes resolution on the next agenda – Bay Head passed it – there will be no negotiation on this – only one town has nodes and is having big problems.
BA/CFO Riehl: AT&T Mobile is looking to put equipment on the water tower – have reached agreements and will get increased rents from them – Sprint has come forward as a new carrier – working with consultant on the bid specs – could garner another $25K-$30K in revenue.
The Clerk announced additions to the agenda.
Councilman Cortes asked that item 1y be considered separately. Councilman Kanitra asked that item 2d be considered separately.

Motion by Councilman Migut to approve RESOLUTION 5: Authorization to contribute $4K towards the town clock, died for lack of a second.
Motion by Councilman Kanitra to deny RESOLUTION 6: Approval of payment of Pay Cert 4 to Albert Marine for Lk Dredge/Shoreline Restoration ($195,669.92), and wait on payment until work is completed, was withdrawn by Councilman Kanitra as, per Attorney Riordan, the Borough Engineer certified the request for payment, there is a statute that requires prompt payment to contractors and BA/CFO Riehl and Council reviewed the list (Councilman Toohey: asked what would happen if an engineer did certify a bill in error; Attorney Riordan: that’s what an engineering firm’s malpractice insurance is for and the statute has some wiggle room for municipalities; BA/CFO Riehl: explained that if there is an error on a pay certificate, there will be an adjustment on the next one) they did a poor job with sediment control measures.

Ordinance 2018-06 (Add/Remove Handicap Spaces) was considered on second reading. Mayor Reid opened the public hearing with no member of the public wishing to be heard. Motion by Councilman Migut to close the public hearing and adopt Ordinance 2018-06 was seconded by Councilman Santanello, and carried by roll call vote.

John Hilla, Joe Leone’s, PPB: asked for the specs of single use bags (Mayor Reid: vendors have been asked to consider other options like paper, not necessarily single-use bags – can put cheese and meat in plastic; Attorney Riordan: read from the ordinance).
Councilman Kanitra: Environmental Stewardship Ministry in Brielle wants a copy of the ordinance (Mayor Reid: Bay Head does too).

Councilman Toohey: BA/CFO Riehl did a fantastic job – are at half of PPB’s debt ratio.
Ordinance 2018-09 (Capital Bond Ordinance) was introduced on first reading. Motion by Councilman Toohey to approve Ordinance 2018-09 on first reading was seconded by Councilman Vogel, and approved by roll call vote. The public hearing will be held on June 19, 2018.

Lee Kelly, PPB: commended SLEOs, who worked all day in the cold during the gas line replacement on Washington Ave. – County services on County roads are appalling – St Louis, Baltimore and Ocean are a disgrace – need liaison with County to ensure PPB gets full tax value.
Councilman Vogel: confirmed that Memorial Day Bike parade starts at 10AM.
Vince Castin, PPB: storm is blowing dredge materials around – it is a big issue.
Dave Cavagnaro, PPB: sand is built up above the height of the Boardwalk – asked whose responsibility it is to sweep it when it blows onto the Boardwalk; opposes free parking at Risden’s lot; asked if Borough Hall, Police and DPW are protected from electromagnetic pulse.
