The Governing Body reserves its right to amend and supplement the purposes of executive session by motion at the public meeting.
Mayor Kanitra called the meeting to order at 7:30PM. Present were Councilmembers Vitale, Testa, Cortes, Santanello and Migut. The Municipal Clerk read the notice indicating compliance with the Open Public Meetings Act: “Adequate notice of the time and place of this meeting was given under the provisions of the Open Public Meetings Act and was posted and sent to the officially designated newspapers in compliance with the law.”

ADDRESS BY COUNCIL PRESIDENT
Council President Migut: met with CFO Riehl and Parking Authority about a proposal for the railroad lot – wants to issue 120 parking passes to Arnold Ave. businesses, primarily east of Rte. 35S, for their employees – will open 126 spots downtown for shoppers and restaurant goers – raising the daily rate to $1.50/hour could compensate for revenue lost – monthly commuter pass rate is below that of surrounding lots and should be raised – will take communication and cooperation – it’s what the business improvement district has been created for – will work with the Chamber – all parties should see the common good – through an ad campaign, social and commercial media, word would spread that PPB is more customer friendly – asked that the Attorney be authorized to revise the necessary code, in conjunction with the CFO’s recommendation, for necessary rate increases and creation of the parking pass – added as item 3i (Mayor Kanitra: met with the Chamber, who said a lot of businesses hide employees in the lot behind Borden’s – even moving them out of that lot would increase parking for residents, tourists and businesses) envisions 60 passes used by daytime employees and 60 during the evening shift (Mayor Kanitra: would need employers to collect passes upon employee terminations) will discuss at February Parking Authority meeting – hopes businesses come to the March meeting, with passes issued at the April meeting and rate changes/passes effective May 1st (Mayor Kanitra: per BA/CFO Riehl, lot is almost never full, except for a few hot summer Saturdays and Sundays – not losing revenue; Councilmember Cortes: many commuters go to Bay Head because parking is free; Councilmember Santanello: asked about prohibiting summer weekends) not this year.

Councilmember Santanello…ABSTAIN
RESOLUTION A: Appointment to fill vacancy of Mayor Kanitra’s former Council seat)
Mayor Kanitra: the Regular Republican Organization of PPB has authority over this position – he and Club President Jack Pasola convened a screening committee to meet with applicants – made a concerted push to encourage application – 7 individuals interested – all qualified – different backgrounds – tried to remove himself from the situation – it is the County’s Committee’s job to propose names, but they could not get a quorum for a meeting – it's now Council's responsibility – vacancy can be filled by any registered Republican PPB resident – fair process – totally open – invited suggestions from any Councilmember (Councilmember Santanello: asked for clarification – he read that the Municipal Committee of the political party of which the incumbent was a nominee shall have no later than 15 days of the vacancy to present to the Governing Body the 3 nominees for the selection – sounds backwards that the Regular Republican Club came up with the names) that’s why the Regular Republican Club hasn’t put forth any specific names (Councilmember Cortes: asked if Council will be given 3 names; Attorney Riordan: unfortunately, Councilmember Santanello did not read the rest of the statute; Councilmember Santanello: Attorney Riordan is the Municipal Chair and Borough Attorney – has a clear conflict of interest – respectfully requested he not comment on this; Attorney Riordan: appreciated Councilmember Santanello’s comments but said he was going to read the statute; Councilmember Santanello: will file an objection with the State Bar that he is interrupting; Attorney Riordan: read the statute, “if the Municipal Committee which nominated the incumbent fails to submit the names of the nominees within the time prescribed herein the Governing Body may within the next 15 days fill the vacancy by the appointment of a successor from the same political party which had nominated he incumbent whose office has become vacant” – appreciates that Councilmember Santanello doesn’t like it, but once the Committee did not provide the 3 names within 15 days, the Governing Body has no choice but to figure out where they’re going to find the appointment; Councilmember Santanello: it’s not just that he doesn’t like it, he doesn’t think Attorney Riordan should be commenting on it because he has a conflict of interest – also thinks he was derelict in his duties as Municipal Chair for not getting the Committee together) Councilmember Santanello can nominate any Republican in town; Attorney Riordan: any member of the Governing Body, including the Libertarian, may make a motion and, if there is a second, it gets voted on in the ordinary course) has nothing to do with the County Committee, but if Councilmember Santanello is upset that someone wasn’t included, he can nominate them now (Attorney Riordan: if either would like to know what went on at the County Committee, they can discuss it with him after the meeting) invited nominations.

Mayor Kanitra: Carolyn Villani was a Reid appointee to the Planning Board; as he didn’t want to assume anything, she won’t be seated until the next Council meeting; thanked all who were interested in the process – Art Gant is an incredible choice as well (Councilmember Santanello asked if he was interviewed) yes.
COMMITTEE REPORTS:
Councilmember Vitale: announced the passing of former Fire Chief W. Lee Fox, a devoted member of Ocean Fire Company No. 1 for 55 years – thoughts and prayers are with his family; met with the Fire Committee – looking at grants and ways to fund a fire truck purchase, as one of theirs is more than 20 years old – Fire Dept. is looking for new members – Mayor will be holding a community engagement night with Committee Chairs – residents can sign up for organizations – will invite the Fire Dept. and First Aid; he and Det. O’Neill are working on a community watch program called the Neighborhood Partnership Initiative – first meeting is February 26th at 7PM is a presentation on social media safety and good cyber hygiene – Chief Michigan and members of the Police Dept. will be there – goal is to have monthly speakers – residents can come and speak about the issues they’re seeing in town – working on Facebook page, to be monitored by the Police Dept., where residents can post information for the public, after calling 9-1-1; gave Chief's report – training since last meeting includes Canine, SWAT In Service, Critical Incident and Terminal Agency Coordinator – activity includes arrests for Possession of CDS, DWI and other motor vehicle offences and Contempt of Court – the Dept. thanks honorary Police Officers Caesar and Deanna DePaco for their generous donation of a vehicle for the canine unit – they are strong supporters of law enforcement agencies – Dept. is committed to keeping PPB a quiet and safe community for residents and visitors – asked that Police be called immediately with issues or concerns (Mayor Kanitra: Interceptor on tonight's agenda is backed by the DePaco’s donation and will not come out of town funds; Councilmember: has always supported one new vehicle each year); looking into complaints about increased water/sewer bills on social media and the Next Door app – summer consumption is usually the highest of the year and water rates are billed on a tiered system; will work with BA/CFO Riehl for reimbursement on item 1c; he and the Mayor met with Recreation Committee Chair Simonovich about their expectations – took over as administrator of the Rec web site, developed by PPBHS, to go live shortly – have 15 members, up from 5 last year, with 4-5 more set to join – first meeting is the 27th – will discuss 2020 programs; on January 27th, is meeting with BA/CFO Riehl and IT vendor All Covered about securing systems.
Councilmember Testa: Arts Committee, a wonderful group, is putting together fun events including a Black & White Masquerade Gala at The White Sands on March 21st – tickets are on sale on www.pointbeacharts.com for $65 – are also taking submissions for a juried art show – are working with the Chamber this year and there is a calendar on their web site – meetings are the second Monday of every month; attended the Board of Education Reorganization Meeting – congratulated the new BOE President Ramos and new Board Member Finn – meetings are the 4th Tuesday of every month at 6:30PM at Antrim School and open to all; met with BA/CFO Riehl about a bicycle/motorist/pedestrian safety initiative, like Greater Mercer’s Street Smart – would like; met with Chief Michigan about bicycle safety and Det. O’Neill about the hoedown – looking at education and signage to reduce close calls; thanked Clerk Farrell for work on the Reorganization meeting.
Councilmember Cortes: recognized January employee anniversaries – Derek O’Neill 21 years, Eileen Farrell 16; he is co-liaison to the Beautification Committee with Councilmember Testa –Committee is meeting next week with 5-6 new members; is Shade Tree liaison for now – spoke about the Big Beautiful Tree program – trees will be delivered and professionally planted for $350 – working with ZO Tumolo on Kevin Scibilia’s inventory of hazardous trees – Commission has identified streets that are barren of trees and will plant some – residents will receive mailing about the project – past projects have included Broadway, Richmond and Washington Aves. – PPB achieved Tree City USA status in December and signs will be put up at entrance roads – supports hiring a part-time person to water and care for trees but members can also fill out paperwork to drive the Toro and do it; Newark Ave. playground equipment was delivered, trees were trimmed in Pleasure Park and the Water Dept. building is being painted; NJDOT planted a few trees (Mayor Kanitra: they even ground down the stumps from the JCP&L trees, which were an eyesore; Kim Dietz has been running the Farmers Market in Borden's lot – has scaled down and she is now looking to use public property next to the gazebo and Post Office – would free up Borden’s lot – DPW would not have to put out and retrieve barricades she sets up on Saturday nights and the Post Office is fine with using their lot; Ms. Dietz: 10 spots at the Post Office each equal a 10’x10’ pop up tent – can also get about 10 tents on the grassy area; Mayor Kanitra: Post Office is closed on Sundays; Ms. Dietz: will talk to them about farmer parking and set-up – there are benches, trees and a garbage receptacle – would be a comfortable place to shop – can use the gazebo to highlight special events – has a musician friend who would love to put together some events; Mayor Kanitra: would be high visibility – smaller footprint looks fuller – would love to get a musician or painter there through the Arts Committee; Ms. Dietz: doesn't want her customers to have to pay to park in the lot next to the firehouse; Councilmember Santanello: maybe Councilmember Vitale can talk to the Fire Company about that) added as item 3j; asked if anyone knows about elevation marks on St. Louis, from Newark to Washington Aves, (Mayor Kanitra: elevation is off, but they are not paving there yet); Jenkinson’s is wrapping up – spoke to BA/CFO Riehl about replacing the guardrail on Broadway east of Ocean Ave. with a combination bollard/bike rack.
Councilmember Santanello: echoed Councilmember Vitale’s comments about Chief Fox – was glad to represent the Governing Body at the funeral and express condolences to the family – very moving service; asked Council President Migut to provide Councilmembers with the draft agenda, as is tradition; 2019 anticipated revenue is $564,861.00 over what was anticipated – a combination of retirements and the new parking system that he and BA/CFO Riehl put in – constituents should be asking for a tax relief this year.
Councilmember Migut: Animal Welfare Committee spring fundraiser is at The Ark in March – more information will be provided at next meeting – dinner, cash bar, silent auction; Planning Board will reorganize on February 11th – meetings have been moved to the 2nd Tuesday of the month – there is an application for site plan review at the Coastal Creations building, next to the Ark, which has been sold; Finance Committee will meet next week for the first time – BA/CFO Riehl will set a date.
Mayor Kanitra: will have office hours on Mondays and Tuesdays and Friday afternoons – schedules a lot of town meetings on those days – no set hours; thanked ZO Tumolo – went on his first ride along with her a couple of weeks ago as part of his commitment to strong code enforcement – they identified commercial properties strewed with trash, things that had fallen down, etc. – will ride around with her monthly to assess things; Mayor Reid brought back the Offshore boat race during his tenure – was approached by Toni Potthoff, who runs it – spoke to a lot of people and thinks it would be good to bring it back – attracts tourists in early June when hotels and motels are not at full occupancy – they believe they bring in 5K tourists, which is good for businesses – roughly $10-12K in Police overtime is not reimbursed – they are not looking for anything else from the Borough – proposed dates are June 12th, 13th and 14th (Councilmember Cortes: was also contacted by Toni – reached out to Assemblyman Clifton at Comcast about sponsoring it – Mr. Clifton will pass on the information to NBC Universal, which Comcast owns – Xfinity sponsors NASCAR events – Mr. Clifton said PPB would need to rectify the franchise agreement (Attorney Riordan: that’s extortion of agreement concessions in exchange for race sponsorship – will get in touch with the Assemblyman) offered to look for regional and national partners as potential sponsors to offer a bigger purse – would keep boats in NJ Transit lot, where power is installed – added as item 3k; spoke about item 1h – was approached by the Littoral Society about a support letter committing to awareness and education for summertime guests about reducing marine debris; met with the Chamber Executive Director Vacarro about this administration’s initiatives and how to work together – all want to see downtown flourish – saw a commitment from the business owners to revitalize downtown vibrancy; administration wants to pride themselves on transparency – will not try to sneak an agenda item passed anybody – will make sure it is addressed and the right thing for PPB – addressed item 1b – the Quality of Life person will be a specialist in business and economic development – need to revitalize downtown, turn PPB into more of a year-round community and stop business turnover – is spending 30-40 hours/week on Mayoral duties and still doesn’t have the bandwidth to get to everything he wants – needs someone to attend meetings, etc. – this individual will pay for him/herself many times over – grant opportunities will be a big part of this person’s purview, along with NJ Best Practices – will forge relationships with State, County and Federal officials to ensure PPB is getting its fair share of monies – will be a point of contact with utilities – will quarterback a Senior Committee, a quarterly town newsletter and annual resident survey – will oversee neighborhood listening sessions, resident complaints, new computer system and a business improvement district – many Borough employees already go above and beyond and take on additional responsibilities – part-time Maintenance Worker will not be a DPW employee but will work with DPW – will pay attention to the details, drive around ensuring there isn’t a single piece of trash blowing around, be certified for weed control and pre-treat and spot treat the entire town – will water new trees, make sure all curbs are painted, ensure a clear street sweeping schedule, keep up with graffiti at the Inlet, do park upkeep and perform landscaping duties – both positions are vital to attracting full-time families, visitors and good business (Councilmember Cortes: not a big fan – current employees already do this – cost will go up every year – wondered about Civil Service, benefits, where these positions fall in the pecking order and what kind of authority the Quality of Life Manager will have) will report to BA/CFO Riehl and work with her and him on a regular basis – having talked to 1,000 residents – this is the #1 issue that they care about (Councilmember Cortes: his biggest issue during elections was taxes – no one likes taxes to go up – Code Enforcement and Police handle municipal ordinance compliance – Engineer and Dept. Heads facilitate grant funding – have a Historic Preservation Commission, Engineer and Planning Board – Council addresses and resolves quality of life issues – Administrator is the liaison to between the Governing Body and public – Council President or a Councilmember would represent the Mayor and Administrator at meetings if they couldn’t make it – have DPW and Beautification people in place – building owners/businesses are supposed to maintain weeds at storefronts – asked where the Maintenance Worker's budget and truck would come from) would share the custodian’s vehicle – PPB has one of the only DPW’s without someone certified in weed control (Councilmember Cortes: doesn’t agree – asked where materials will be stored; Councilmember Santanello: reads like a replacement for Code Enforcement) can alter the job description – came from a State template – goal is not to step on Code Enforcement’s toes (BA/CFO Riehl: they are Civil Service positions – descriptions came from the Civil Service web site; Councilmember Santanello: will also be benefits and pensions, which will keep going up – there is no written chain of command; Attorney Riordan: the law is that everyone reports to the Administrator – she has all the power) this is certainly no attempt to usurp the power of the Administrator – they worked on this together (Councilmember Santanello: concerned about the power structure – wondered if Governing Body should pass constituent calls to the lifestyle manager or if they are allowed to respond) can work that out and keep a record of what is being done – is happy to have Council continue to do their duties (Councilman Santanello: sounds like an unelected Deputy Mayor – is concerned about the money t – shouldn’t be advertising until the position is created).

There is no intent to step on anyone's toes – will continue to work with BA/CFO Riehl on the job description (Attorney Riordan: this is the ordinary procedure – the Administrator has always been doing it this way); spoke about item 1e – it's a travesty that the Historic Preservation Commission has no real strength and no ability to protect historic properties – this is a step in that direction – wants to start focusing on downtown and commercial properties – wants the Commission to have say in the Planning Board and Zoning Board process with relation to historic properties, to motivate people to do the right thing and make it harder to do the wrong thing; has a meeting scheduled with the head Coast Guard brass and Congressman Smith in Washington DC about the divestment of the Coast Guard Building – will be submitting comments, in conjunction with the Historic Preservation Commission to achieve National Historic Preservation status, so it can be maintained for future generations – would love the Historical Society Museum in there and for the committees to have meeting spaces there – will report back after that meeting; there are additional State grant opportunities for blue green algae blooms – have partnered with Save Barnegat Bay – looking to make Lake of the Lillies healthier through nanobubbling – asked the Engineer to work with Point Pleasant on shared services pricing to check out draining system; need to hold contractors more accountable – met with Earle about the rushed paving job on St. Louis Ave. – was he said/she said between the Borough Engineer and Earle – will see them in court if road is not done to satisfaction – decided to hold the next $70K payment on that project (Attorney: asked Mayor Kanitra about additional changes to the Historic Preservation ordinance, other than the resolution that was part of the amended agenda he received this afternoon with changes only to the membership) can start looking at it in conjunction with the Commission that is gathering ordinances from other towns (Attorney Riordan: asked how the resolution got changed; Clerk Farrell: clarified it only, did not change it; Attorney Riordan: suggested that this was not what the Mayor intended) Commission would now like to stay at the same number of members.

PULIC PARTICIPATION BEGAN AT 8:57PM
Dave Cavagnaro, PPB: asked about1b salaries, about 3k, about train lot passes; many years ago, there was a bicycle safety committee that wanted more racks advertised at key locations.
EJ Geiger, PPB: spoke about Quality of Life Manager and employee passes in railroad lot.
Vincent Castin, PPB: as a taxpayer, appreciates the $560K surplus; asked about 2g; asked about Maintenance Worker responsibilities; spoke about his Coast Guard Station research – will be happy to work with Mayor Kanitra on it; asked about Mayor Kanitra’s hours.
Christopher Porzio, PPB: thanked the Governing Body for working together to integrate ideas; are the stewards of the waterways; should be “no littering” signs and fines for lake littering – suggested educational signs indicating the types of species living in the lakes; is interested in joining the Environmental Commission.

Mayor Kanitra: told Councilmembers Cortes and Santanello that he appreciates the cordial meeting – hopes it sets a precedence – every concern/talking through everything is valid and transparency is important – if all is done in a respectful manner, will have a pretty good 2020 (Councilmember Santanello: had a pleasant e-mail exchange – he is not starting any fights – made an offer of peace and intends on continuing it – politics is over – have to govern together – other than his disagreements with Mr. Riordan, which will be continual) he is not starting fights either – he relayed his excellent gesture to others (Councilmember Testa: appreciates it).
PUBLIC PARTICIPATION BEGAN AT 9:27PM
Dave Cavagnaro, PPB: spoke about Jenkinson’s sea wall.
EJ Geiger, PPB: asked if there would be more repair work on Arnold Ave. where it was dug up for gas line replacement; if there will be more pay stations this year, and about televising meetings.
Mike Ramos, PPB: thanked the Governing Body for their well wishes – first time that a Mayor and 2 Councilmembers attended a BOE meeting – meant a lot to them.
Lee Kelly, PPB: asked about a downtown paving plan and leaning telephone poles along Ocean Ave.; streetsweepers can’t get the County roads clean – not getting fair share of County road work.
Mayor Kanitra: thanked all for coming out and sitting through a 2+ hour meeting – hopes the meetings won’t last nearly as long, going forward.

Motion by Councilmember Cortes to close public participation and adjourn was seconded by Councilmember Migut and carried by consent of Council. Meeting was adjourned at 9:44PM.
