October 25, 2018 BOA minutes
The October 25, 2018 Regular Meeting of the Board of Adjustment opened at 7:30pm. The clerk read the notice of compliance with the "Open public meetings act." Present were Board members: Mr. Spader, Mr. Kelly, Mr. Reilly, Mr. Dixon, Mr. Schneider, Mr. DePolo and Ms. Crasper
Absent – Reynolds, Struncius, Davis and McGee

Motion by Mr. Kelly, second by Mr. Schneider to memorialize the minutes of September 20, 2018

Application #2018- 23 Anthony LoSchiavo – 114 St. Louis Avenue – Block 155; Lot 15 – Applicant relocated existing shed over property line and pool was accidentally located in wrong location.
(Applicant carried w/o notice – requesting to be carried w/o notice to January 17, 2019)

2018-15 – Ocean 103 Equities, LLC – 103 Philadelphia Avenue – Block 33 – Lot – 1.02 – Applicant wishes to construct a new FEMA compliant single family dwelling.
Michael Rubino, Esq. attorney for the applicant. Michael Rubino reviewed previous meeting and the corrections that have been made to the plan. Since the last meeting his clients have purchased lot 1.01. The corner lot house has been moved to the south by 5 feet. Requesting a setback on Ocean Avenue for 20 feet where 25 feet is required. Applicant is willing to memorialize the setback in some type of deed that the homes have to remain 20 feet part. All other coverages have been met. Dennis Galvin stated that it is two separate cases but he believes that it is OK to hear them together. John Jackson, Esq. sworn, explained he represented the applicant that subdivided the lots. Both lots lack depth – they are irregular lots; he explained that the Planning Board had no trouble with the subdivision but would not approve a building envelope without seeing the homes so that is left to the Board of Adjustment to grant variances.
Kevin Crowe, 105 Philadelphia, inquired if he could get a short adjournment so his attorney could be present. He has an issue with the setbacks.
Kevin Crowe, sworn, would rather have his attorney present. Dennis Galvin explained that the applicant also has rights. Also since he has an attorney the applicant’s attorney cannot speak to him. He is worried that it might block his garage if he wants to do anything with it in the future. Dennis Galvin stated that the board knows his concerns and will proceed.
Robert Algerin, Professional Architect, credentials accepted, Exhibit A-6 entered, updated plot plan lot 1.02, depicting where the house was and where it is now. House conforms to coverage and height; also has to conform to site triangle. The irregular shape of the lots presents hardships. The northern lot, 1.01 is 5,000 sq. feet. That only requires a 5 foot front yard setback. The lot depth is an exciting approved non-conformity. John Dixon inquired if the home has been reduced. Robert Algerin replied it has been reduced by 13 square feet. John Dixon stated that the applicant is looking for three variance for 1.02 and have only reduced the size by 13 feet. Vice chair Reilly replied that at the previous meeting the board had requested for the home to be reduced in size.
Motion by Mr. Spader, second by Mr. Dixon to carry application #2018-15 and 2018-25 of Ocean 103 Equities to November 1, 2018 without notice.
