November 2, 2017 BOA meeting
The November 2, 2017 Regular Meeting of the Board of Adjustment opened at 7:30pm. The clerk read the notice of compliance with the "Open public meetings act."
Present were Board members: Mr. Kelly, Mr. Schneider, Mr. DePolo, Mr. Davis and Ms. Crasper
Absent – Mr. Spader, vice chair Reilly, Chairman Struncius, Mr. Dixon and Mr. Reynolds
Motion by Mr. Schneider, second by Mr. Davis to nominate Lee Kelly as acting Chairman

Applicant wishes to lift existing single family dwelling and add dormers, deck and stairs.
(Paesano not being heard due to deficient notice)
Application #2017-27 – Robert/Lynn Montefusco 13 Beachcomber Lane aka 6-4 – Block 121 Lot 6.04 – applicant wishes to demolish existing single family dwelling and construct new 1 ½ story FEMA compliant single family.
Mike Rubino, attorney for applicant, stated that the existing home is small and the applicant would like a little additional space upstairs. The home is being built in the existing footprint. Robert Montefusco, applicant, sworn, stated that he grew up in the summers in Point Beach since he was a child. His brother owns a home on the same block so it was a no brainer when the home went up for sale. He has two daughters and grandchildren and he would like a little more room for privacy. Photo Board entered as A-3. Mr. Schneider inquired how many other homes have been raised on
Beachcomber. (5 homes) Robert Montefusco stated that the home is severely warped inside from previous water damage. Mr. Davis inquired if the foot print could be slightly reduced which will improve emergency access. (Yes) Photo A-4 entered –
Craig Brearley, Professional Architect, sworn, credentials accepted, reviewed the process of designing the new home while maintaining the footprint. Proposed home is 1 ½ stories. First floor kitchen, laundry, bedroom and bath (846 sf). Second floor is 2 bedrooms, bath and deck – 403 sf. There is some open space in rear of home – it will be fire rated under the vinyl. Mike Rubino stated that they will remove 6 inches off the rear of the home.
Bob Kuhn, Najarian Associates, Professional Engineer, sworn, credentials accepted, stated that the rear setback will now be a minimum of 2 feet. The home will be FEMA and code compliant.

Schneider – All those track house were small bungalows, but the time has come to improve. Much safer situation – up to code modest home – in favor
Davis – Thank you to the applicant for making the change to the setback – yet to get guidance for the bungalow zone –
DePolo – Improvement to neighborhood – hardship to homeowner and the compromise that he made – fire safety improvements help sway the vote. Two brothers living near each other will be in for the long haul.
Crasper – Modest home – tight in there – looking at the other homes it is characteristic for that area.
Kelly – Commend the architect for a modest plan – fits in Beachcomber very nicely – was concerned about rear setback – applicant made adjustment. Getting new fire safe attractive home – In favor

Mike Rubino, attorney for applicant, stated that the existing home is small and the applicant would like a little additional space upstairs. The home is being built in the existing footprint. Home will need variances for rear yard setback. Home will conform to height requirement but will need a variance for half story.
Ronald Montefusco, applicant, sworn. Exhibit A-3 – photo. Has owned property since 1986. Home is utilized by his daughters and grandchildren. Made sense to build home after Sandy. Finally found a reputable builder and am looking forward to a new home. Has not been able to use the home since the storm. Will have a master bedroom upstairs and two bedrooms downstairs. This is something that the family is very excited about.
Craig Brearley, Professional architect, sworn, credentials accepted, stated that he has designed the home to match the footprint – home is 39.9 feet deep. Home is also fire rated in rear – upstairs is the master bedroom and bath. Two bedrooms downstairs and bath. First floor will be built to elevation 12 – height will be 24 feet ¾ inch. Home is designed with a cape look. Siding will be lowered to 3 feet above grade. Believes that the home is now a much safer structure.

Schneider – My concerns were alleviated – house is well designed and modest – area is safer – better for town and neighborhood.
DePolo – Aesthetically and nicer, safer house. Modest home – in favor
Davis — Compliments the zone and is FEMA compliant.
Crasper – Nothing to add – In favor
Kelly – Commend the architect – happy to see Beachcomber with two more new homes.
