The May 3, 2018 Regular Meeting of the Board of Adjustment opened at 7:30pm. The clerk read the notice of compliance with the "Open public meetings act."
Present were Board members: Mr. Spader, Mr. Kelly, Mr. Reynolds, Mr. Dixon, Mr. Schneider, Ms. Crasper and Mr. McGee
Absent – Struncius, Davis and DePolo

Memorialize resolution
Motion by Mr. Spader, second by Mr. Kelly to memorialize the action and vote approving application #2018-11 of Sprint Spectrum/Storino – 401 – 405 Boardwalk – with conditions –
In favor: Spader, Kelly, Reynolds and Dixon
Opposed: None
Application #2018-16 – Jeff/Lorraine Bryant – 806 Long Point Lane – Block 118; Lot 17 – Applicant wishes to demolish existing single family dwelling and construct new FEMA compliant single family dwelling with in ground swimming pool.
Mr. Reynolds has stepped down from the Bryant application.
John Jackson, attorney for applicant reviewed the application. Exhibit A-3 – Power point presentation. Applicant bought home two weeks prior to Sandy. Home was flooded and has been sitting unoccupied due to financial reasons to construct previously approved home. This home is smaller than previously approved house. Applicant is requesting a 2 1/.2 foot height variance. First finished floor is at elevation 15. Applicant is looking for a height of 9 foot ceilings due the height of the family. Vice chair Riley inquired if the 4 foot pool fence is adequate. (Yes)
Robert Burdick, PE/PP, credentials accepted, sworn. Robert Burdick reviewed application and stated that the property encompasses 12 feet of Long Point Lane which is a long driveway that services the 7 homes. Robert Burdick reviewed the Board Engineer’s letter. The height required is 35 feet. Requesting 3 – 9 foot floors. New home will provide safety for the community. Bird cage will be removed. Requesting a 22 foot wide driveway in rear; existing driveway is 25 feet. Mr. Dixon inquired why the garage needs to be 8 feet high because his isn’t.
Brian Keller, builder, sworn, stated that reviewed the plans for the home. Brian Keller explained that the standard garage door is 7 feet and that is why the garage is 8 feet high. Staircase in enclosed in the home. Home is 4,071 square feet. Mr. Dixon inquired where the building supplies will be stored. Brian Keller stated that all supplies will be delivered from Cedar Lane and kept on the property.
Jeff Bryant applicant sworn, reviewed family history of property. Original home that was approved came in 40% higher in cost and they could not afford to build it. They are now ready to build. Jeff Bryant is looking forward to 8 foot doorways; he is tired of ducking through doors.

Deliberations
Spader – I think it is a beautiful presentation: kudos to the presenters. Had some of these before with the inside staircase and I think it is a plus. I think that the house even with the extra 2 feet in height that it fits in the neighborhood. The way it is presented is the way it has to turn out. Something nice and clean and safe meeting the flood standards.
Kelly – I remember the other one; quite frankly I like this one better. You have extra walking area. I like the design of the house. I think it is a very nice element in that area; it fits very nice there. I have no problem.
Dixon – You have a FEMA compliant home – concerned about the height but it is a larger lot.
Schneider – Nice addition to the neighborhood; well designed – good presentation. Normally be concerned about the height but where it is it is not a major concern. Good addition.
Crasper – Agrees with Mr. Spader – certain areas it would not fit but in this particular area I think it is going to fit.
McGee – To reiterate it is a unique part of town; it is a historical part of town and I think this maintains the architectural integrity.
Reilly – I agree with everything that has been said and no one is here to object.
Motion by Mr. Spader, second by Mr. Kelly to approve application #2018-16 of Jeff/Lorraine Bryant at 806 Long Point Lane with conditions

Application #2018-14 – Steven/Heather Roogow – 115 Washington Avenue – Block 27; Lot 8 – Applicant wishes to demolish existing single family dwelling and construct FEMA compliant single family dwelling with in ground pool. Also requesting two curb cuts.
Mr. Spader has stepped down from the Roogow application.
Mr. Reynolds has returned to the Dais and Mr. Spader has stepped down from the Roogow application.

Matt C. Hockenbury, PE/PP, sworn, has appeared before boards in Toms River, Lavallette and Brick. Proposed building height of house is now 33.1 feet and the second curb cut request on Baltimore has been removed. A-3 – is revised plan with a revision date of May 1, 2018. A-4 Sheet A2 of Architectural plan with revision date of May 1, 2018. A-5 is sheet A-3 of revised Architectural plan with a revision date of May 1, 2018. Applicant is now proposing a 13 foot curb cut on Washington Avenue. Pool equipment will be conforming. Storage area/garage is 8 feet/2nd floor 9 feet and third floor habitable space is 8 feet. There is no habitable space in the attic and it will have pull down stairs. The applicant has agreed to install sidewalks on Baltimore Avenue.
Audience questions
Susan Giordano, 113 Washington, sworn, lives directly next door and is concerned of the 3rd floor balconies and her privacy. If the home is rented people will be out on the porch. Susan is a teacher and gets up at 5:30am. Heather Roogow replied that it is the Master bedroom and she does not want anyone else in her bedroom.
Deliberations
Mr. Kelly – I am happy to see a nice plan and something being done on that property. I am very happy that you are doing sidewalks. Sidewalks are a pet peeve of mine.
Mr. Reynolds – – Corner lot and you have done what you need to do. Good application and I do like the looks of it.
Mr. Dixon – FEMA compliant home and the owner is willing to work with the board. Looks like a nice house.
Mr. Schneider – As we all we all know it is hard to find a corner lot that you ca meet all the conditions. It is placed nicely on the lot. The applicants good will that they did change the height. In favor
Ms. Crasper – Can only reiterate what the Board has said previously. I accommodate the applicant for making adjustments based on Ray’s letter.
Mr. McGee – I agree. Beautiful home – I think the discrepancies are deminimus.
Vice chair Reilly – Can’t say much more than that – my only concern is the neighbor and the balcony. He inquired how far the balcony was from her window (10 feet)
Motion by Mr. Dixon, second by Mr. Schneider to approve application #2018-14 of Steven/Heather Roogow – 115 Washington Avenue – Block 27; Lot 8 with conditions

Application 2018-15 – Ocean 103 Equities, LLC – 103 Philadelphia Avenue – Block 33; Lot 1.02 – Applicant wishes to construct a new FEMA compliant single family dwelling.
Michael Rubino, Esq, applicant for attorney reviewed the application and variances requests. Exhibit A 4 – contract of sale Exhibit A5 – Planning Board resolution. The depth is driving the variances. Requesting 2 side yards instead of one side yard. Honoring the 5 foot side yard setback but requesting 5 rear yard variance.
John Freeman, PP/PE, sworn, credentials accepted. Reviewed the Planning Board sub-division which created a non-conforming irregular lot. Mike Rubino reviewed that the Planning Board would not grant a building envelope without a building plan so only the subdivision was granted.
Dennis Galvin informed the applicant that they could go to the county to get relief from the site triangle that would allow them to move the home forward to improve the rear yard variance. Dennis Galvin said they should move on to the architect’s testimony because he believes there is a bigger problem with the volume.

Robert Algarin, registered Architect in NY/NJ, credentials accepted reviewed the architectural plan. The home is 2582 square feet. He said to conform on the lot the green area would have to be removed. One variance is for the little staircase the goes towards the garage (Transparent) and the other is for the rear yard setback. Vice chair Reilly inquired the amount of Bathrooms and bedrooms. 5 Bedrooms and 4 Bathrooms. Mr. Dixon stated the house is too big for the lot.
Mike Rubino spoke with his client and is asking that the application be carried to June 21, 2018 without notice to give the applicant time to reach out to the county to see if they can adjust the site triangle.
The applicant waives the time for the application to be heard.
Motion by Mr. Spader, second by Mr. Schneider to carry application #2018-115 of Ocean 103 Equities, LLC located at 103 Ocean Avenue to June 21, 2018 without notice.
