The March 18, 2021 Regular Meeting of the Board of Adjustment opened at 7:00pm. The clerk read the notice of compliance with the “Open public meetings act.” Present were Board members: Mr. Kelly, Mr. Dixon, Secretary Schneider, Mr. Pasola, Mr. Loder, Mr. Davis, Mr. McGee and Chairman Struncius

2021-05 – Stan Osofsky – 101 Atlantic Avenue – Block 63; Lot 1 – Applicant wishes to build new single-family dwelling which does not conform to front yard setbacks.
John Jackson, attorney for applicant, Reviewed proposed application and variance request. Power Point entered as Exhibit A-3.
Arnold Boyle, PA, credentials accepted, sworn, reviewed architectural plans. House contains 5 bedrooms and two full baths. Second floor contains kitchen and master bath; house contains elevator. Requesting to hold the footprint of the existing house. Boston Avenue requesting 6.5-foot setback: Atlantic Avenue front setback is 14.8 feet to base of stairs. Chairman Struncius inquired if this dwelling is in line with neighboring home. Wants to ensure that the house proper’s line up. Arnold Boyle guaranteed that they do and referenced the plot plan. Chairman Struncius noted there will be a condition that the house lines up with neighboring home. John Jackson stated they will slide the house back a few feet to ensure conformity with neighboring house.
Front of home at 25 feet. What is the depth of the covered porch? (4.5 feet) Dennis Galvin stated the applicant does not have a hardship for the setback on Atlantic Avenue and would like to see it improved. Mr. Pasola would like to see the house moved back. Applicant will side home with cedar impressions. Attic ceiling height is 5-feet; nothing habitable. Landscaping will be gravel.
Stan Osofsky, applicant, sworn, has owned douse for 5 years. Stan Osofsky said ¾ inch stone that does not travel. Preference is to stay with the stone.
Jennifer White, PE, credentials accepted stated the building coverage allowed is 30% were proposing 29.9% and the existing is 40.7 impervious coverage, the maximum 50% existing 42.7 and we’re proposing 29.9.
Deliberations
Kelly – I think this is a nice application; I like the idea of the stone. I think they will do a nice job.
Dixon – Have no problem with the side yard setback along Boston; a little concern with the porch but I do not think it will hurt the neighborhood.
Schneider – Understand the close setback on Boston; glad the house is moving back to 25 feet; the porch is like a landing. Will fit neighborhood nicely.
Pasola – I think it is a beautiful home; Boston 6.5 feet and the little change with the front yard means a lot.
Loder – Nice job on the architecture design – everything else has been covered.
McGee – Incline to agree; beautiful home and maintaining alignment.
Davis – convinced by the argument that the compromise on the setback is much more of an enhancement. Getting reduction in impervious coverage. West elevation will be improved.
Struncius- Alignment issue has been resolved other issues have been touched on by board members.
Motion by Mr. Loder, second by secretary Schneider to approve application 2021-05 of Stan Osofsky at 101 Atlantic Avenue with conditions.

Conditions
- The homes itself is to conform with the front yard setback of 25 feet and the porch shall not extend beyond 21.5 feet.
- The home is to be constructed as described to the Board at the time of the hearing. In particular, the shingles are to be cedar impressions.
- The surface underneath the stone yard is to be permeable.
- The westside of the dwelling is to be enhanced and is to be submitted to the Board’s Engineer for his review and approval.
2021-01 – Zefferino/Turbiak – 302A Chicago – Block 108; Lot 22.02 – Applicant wishes to build a new single-family dwelling which does not conform to conditions in resolution.
John Jackson attorney for applicant. Power Point entered as Exhibit A-3. John Jackson reviewed the application and explained plans were approved in 2010 with the subdivision but the applicant would like to build a smaller house. The finished attic has been eliminated and the plans have been revised to eliminate the variance for side yard setbacks. There will be one curb cut. John Jackson believes the house is a better plan and hopes the board will approve the amendment. The lot frontage is undersized but the relief needed is from the prior resolution. Dennis Galvin stated we wanted to make sure that something aesthetically pleasing was being built.
Thomas Hoffman, PA, sworn, credentials accepted, explained the comparison between the old house and the new proposed house. Plot plan to be revised to show a 13-foot curb cut.

Matt Allen – Central Avenue – Questioned the pool and dewatering.
Deliberations
Kelly – Architect has done a nice job and kept with the resolution from 12 years ago. Does not think the pool will be an issue.
Dixon – like the design of the home; it is smaller. Concerned with the flooding but I am sure it will be handled. This will be an improvement to to neighborhood; FEMA compliant home.
Schneider – My objections were addressed; gret addition to the neighborhood. Will like them to repair the sidewalk.
Pasola – I think this is a much better project; as far as the pool they have a very deep backyard and there are many regulations they have to adhere to. Like the street trees and sidewalk replacement.
Loder – I do like the changes they made; getting a fully FEMA compliant house. Like the sidewalks being done.
McGee – an improvement over the original project.
Davis – Echo what my colleagues have said with the house being an enhancement to the neighborhood. Echo the sidewalk issue.
Struncius – Nothing to add; job well done by the board.
Motion by Mr. Pasola, second by Mr. Dixon to approve applications 2021-01 – Zefferino/Turbiak – 302A Chicago – Block 108; Lot 22.02 with conditions.

Conditions
- The revised plot plan is to be submitted to the Engineer for his review and approval and will show one compliant curb cut.
- The home is to be constructed in accordance with the testimony provided and shown to the Board at the time of the hearing.
- The Applicant is to replace the sidewalk.
- The Applicant is to install a street tree as required by the prior approval.
Motion by Mr. McGee, second by Mr. Loder to add the special meeting date of April 8, 2021 at 6pm to the B
