June 18, 2020 BOA Minutes

The June 18, 2020 Regular Meeting of the Board of Adjustment opened at 7:30pm.  The clerk read the notice of compliance with the “Open public meetings act.” Present were Board members:  Mr. Kelly, Vice Chair Reynolds, Mr. Schneider, Mr. Dixon, Mr. Loder, Mr. McGee, Ms. Crasper and Chairman Struncius

Resolutions to memorialize

Motion by Mr. Kelly, second by Vice chair Reynolds to memorialize the action and vote approving application #2020-01 of Lisa/Richard Pizzuta – 301 New York Avenue – Block 41; Lot- 1 with conditions. Application is to submit developer’s agreement to bond for sidewalk improvements.

Agenda

2020-12 – C.V Electric, Inc./Charles Venezia – 4 Minard Place – Blcok121/Lot 8.03 – Applicant is requesting to add front porch and deck. Requiring building coverage and impervious variance.

Applicant requesting 2nd story where only 1 ½ story is permitted. Impervious variance is no longer required. Ray Savacool commented that this is a true 2nd story because it has an 8 – foot wall all the way around. Half story should be located under the eve line.

Charlie Venezia stated he will review the plan and try to reduce the 2nd floor to 500 square feet so he complies. Applicant stated he will also meet the height requirement.

Dennis Galvin stated that he does have some hardship but he needs to comply with the height and half story requirement. Ray Savacool explained the requirements of the ordinance for half story.

John Lord, Professional Engineer, sworn, Credentials accepted, stated that side and rear yard variances previously existed.  Considered moving wall back under eve to comply and remove concrete to comply with impervious coverage. Referred to aerial photo. Proposal is still 3-bedroom with larger kitchen and second bathroom. John Lord said he will modify the plans.

Ray Savacool stated that there is a slope requirement of 6 on 12 for the roof.

Vice chair Reynolds commented that the ordinance is in place to keep away from boxy appearance.

Motion by Secretary Schneider, second by Mr. Loder to add July 23, 2020 at 7 pm to the regular meeting dates.

2020- 09- Michael Traina -300 Atlantic Avenue – Block 50/Lot 20 – Applicant’s final as built exceeded impervious coverage requirement.   The shed is in a non-conforming location and was supposed to have been removed.

Michael Traina, applicant, sworn reviewed his request. Applicant stated that he has 6 inches of pervious matter under the pavers. Ray Savacool commented that the survey submitted had incorrect impervious calculations so the only variance needed is for the shed.  Previously submitted grading plan noted that the shed was to be removed, when the as built came in the shed had been relocated.  Applicant had previous variance for the pool – applicant stated that they did not know that the shed was supposed to be removed. They never had intentions of removing the shed. They do not have storage space for their bikes.

Applicant agrees to move the shed 5 feet from the property line on Chicago Avenue which equates 1 ½ further than it is.  Applicant will make sure that they comply with the 50% impervious coverage.

 

Deliberations

 

Kelly – Congratulate the owners for a wonderful property – it is a show place.

Dixon – Thanked the home owner for being cooperative. Moving it a couple feet is a minor thing to do.

Reynolds – I agree – it is di minimis – shed being moved will be a nicer appearance.

Schneider – appreciate the cooperation – moving the shed makes the property look much better.

Loder – Walked around the property – glad they are cooperating – in favor

McGee – Agreed – considering the history – the pool and the headaches – pick up shed and move it 18 inches easy remedy.

Struncius – nothing to add

 

Motion by Secretary Schneider, second by Mr. Loder to approve application #2020- 09- Michael Traina -300 Atlantic Avenue – Block 50/Lot 20 with conditions

2020-10 – Richard/Nancy Massaro – Block 121/lot 7.02 – Applicant wishes to demolish existing single-family dwelling and construct new single-family FEMA compliant dwelling.

Mr. Dixon has stepped down from the Massaro application.

John Jackson attorney for applicant reviewed the application.  The applicant believes the elevations are attractive.

Brian Murphy, Professional architect, credentials accepted, reviewed the plans. Property is located facing Beachcomber but also on Ocean Avenue. Brian Murphy showed an Aerial entered as A-3 and pointed to all 2-story homes in the vicinity. Brian Murphy showed how the houses on the lane park their cars.

Chairman Struncius questioned the front door facing Beachcomber instead of Ocean Avenue. Ray Savacool commented that the home across the lane does face Ocean Avenue, but some houses on Ocean Avenue do face the lane.

Mr. Kelly mentioned that in the past some homes have provided a bump out to break up the entire side of the house. Brian Murphy stated that he could add landscaping to break up the elevation and you will see the stone on the bottom.

Brian Murphy commented that he could bump the bedroom out 12 inches and add a double window for aesthetics.

 

Nancy and Richard Massaro, applicant, sworn stated they could make the changes needed.

John Jackson commented that it is not a conforming half story according to Point Pleasant Beach. The home will have a high-end appearance.  Richard Massaro stated it will be comparable to the other home (8 Beachcomber Lane) on the lane except this home will be a greyish color.  Mr. Loder commented that this home has a three-window dormer and inquired if they received a variance. (Yes)

Chairman Struncius commented on the construction process since it is on the lane. Richard Massaro stated that the lane will not be blocked and no work will be during the summer. Chairman Struncius requested that they supply a dumpster. Mr. McGee questioned where the construction will be staged from.

 

Audience question/comments

Susan Savelli Beachcomber Lane – Questioned if the home is on the same foot print.  Gives full support to project.

 

Deliberations

Kelly – Mr. Kelly wants the 3-foot fence on Ocean to remain 3 feet.  Mr. Kelly commented that the drawings look massive but they appear bigger than they are actually going to be. I think it will fit nicely and be an asset to the area. Western wall will be an added attraction to the property.

Schneider – I like the aspect of the house – it will be a fire safe house which is an improvement in itself. Usually concerned with second floor but not with this one because it will not affect the neighbor’s being on Ocean Avenue. Overall, I think it is a good design.

Reynolds – I agree with Mr. Kelly said. They previous house had a very similar gable – the half story is built into the house very nicely so I have no problem with that.

Loder – I like the design of the project – I think the variance is deminimis.

McGee – I like the design of the house – it is an improvement of what is existing. Inclined to vote in favor as well

Crapser – The house that they showed on 8 Beachcomber is beautiful – if this is going to be the same it will be beautiful.  I think lower landscaping will be beautiful.

Struncius – Once we addressed the elevation on Ocean, I am OK with that. We are controlling that straight up boxiness –

 

 

Conditions

  1. Same materials are to be used that were utilized for 8 Beachcomber Lane.
  2. The home will be constructed off season
  3. Debris is to be removed daily
  4. Submit landscaping plan to Board Engineer for approval.
  5. Submit elevation revisions prior to memorialization. (West elevation)
  6. Kelly commented that there is a 3-foot fence and would like it to remain 3 feet high

 

Motion by Vice chair Reynolds, second by Mr. McGee to approve application 2020-10 – of Richard/Nancy Massaro – Block 121/lot 7.02 with conditions
