The June 17, 2021 regular meeting of the Board of Adjustment opened at 7:00pm. The clerk read the notice of compliance with the “Open public meetings act.” Present were Board members: Mr. Kelly, Vice chair Reynolds, Mr. Dixon, Mr. Loder, Mr. McGee, Ms. Villani and Chairman Struncius

Agenda
2021-20 – Joseph/Alexis Curro – 15 Water Street – Block 121; Lot 1.03 – Applicant constructed home and the as-built showed the house to encroach the front yard by 4 inches. The framing of the home had been approved by the building department.
Alexis Curro, applicant, sworn, stated that her and her husband built this house and had many obstacles with the builder. Thought everything was fine but when they received the as-built they found out the balcony encroached the setback by 4 inches. It does not impact anyone’s light and air.
Deliberations
Kelly – Down at the house today – looks like it is the trim work. Have no problem with it.
Reynolds – like wise – I have no problem with it.
Loder – I have no issues with it – looking to support this application.
McGee – I also have no issues with this application
Villani – I also have no issues with this application.
Struncius – Same – have no issues

2021-19 – Art/Kaitlin Gant – 506 Cramer Avenue – Block 91.01; Lot 19 – Applicant wishes to install a new garage with a height of 20 feet to better utilize for personal workshop where 16 feet is allowed.
Arthur Gant, applicant sworn, reviewed application. Requesting a garage with a height of 20 feet to include a car lift to work on his GTO. He has an over sized lot which backs up to a parking lot. He is also looking to get a pre fab metal garage; Color will match the home. Would like running water so he would be able to wash his hands. The applicant stated he has a double lot which he could add an easement and sub-divide. Mr. Dixon inquired what type of machinery. The applicant replied just a lift to work on the applicant’s classic car. Chairman Struncius is concerned with the aesthetics. Mr. Kelly commented that the visual lacks details. Chairman Struncius stated that the board usually requires the garages to match the homes and suggest he get a representation with more detail.

2021-02 – Last Wave Brewery – 601 Bay Avenue – Block 91.01/Lot 29/30 – Applicant looking to expand use of existing Brewery to include second building and outdoor seating.
(Last wave was carried without notice from April 15, 2021)
Mr. Jackson attorney for applicant, entered updated Power Point exhibit as A5. Bert Roling, applicant, sworn reviewed the application and layout. Applicant asked to extend hours to 9pm in October and November for the nice evenings. Establishment holds 218 in its entirety. Bert stated that table service outdoors controls number of patrons. Happy to cut off at 94 people outdoors. Chairman Struncius stated the exhibits are not consistent and inquired where the planters will be going and commented the engineer needs to update the site plan for resolution compliance. Chairman Struncius stated some of the things we see in the rendering add to the appeal and want to make sure we are getting what is represented. Chairman Struncius stated it might reduce it to 88 seats but we want what is proposed on the rendering. Bert Roling stated that there will only be table service outside to control the number of customers and environment. Chairman Struncius commented that they do not want to ride by and see 150 people standing and hanging outside. Bert Roling replied that they want a family environment and do not want that either. Ray Savacool wanted clarification about parking on the side. Tim Lurie stated they added 4 parking spots of which one is handicap to only be utilized during the day for employee parking. Mr. Reynolds questioned where the bike rack will be. Bert Roling replied that there will be one out front. Bert Roling also stated that he will separate area when having a private event.
Deliberations
Kelly – Quite frankly I was concerned about the added tables; but after hearing the comments and conditions I am in favor.
Dixon – The applicant has been a good neighbor; don’t see any issues.
Reynolds – This goes a long way towards the revitalization of the downtown. I like driving by this and I can see this drawing people in.
Loder – Looking at being in favor of this application.
McGee – This is a good brewery – It has become a community spot. It will bring more people from Arnold down Bay Avenue.
Villani – I agree you have done a really nice job.
Struncius – This is one of the situations where the board made recommendations and the applicant took that and worked with their professionals and moved this forward and I believe this will be a centerpiece of the downtown.
Conditions
- The Applicant is permitted to have outdoor music, but the music is to be limited to no more than two musicians. There will be no percussion and limited amplification.
- Outside is limited to table service.
- The outdoor brewery operation shall close at 9 p.m.
- The outdoor beer garden space shall not have more than 94 people and they are to be seated. The outdoor beer garden space will be table service only.
- The fence is to be extended along the entire rear of the property.
- The Applicant is to provide a host/security guard to direct patrons to the front entrance and prohibit patrons from leaving with open alcohol containers.
- The construction of the outdoor beer garden is to be consistent with the rendering shown to the Board on the night of June 17, 2021 and it must be reviewed and approved by the Board’s Engineer.
- The Board’s approval is limited to the brewery use. This approval shall never be used as a basis to permit a traditional bar or restaurant without further action from the Board of Adjustment.
- No fork lift operation when brewery is open.
- Landscaping is to be maintained on a yearly basis.
