The June 16, 2022 the Regular Meeting of the Board of Adjustment opened at 7:30pm. The clerk read the notice of compliance with the “Open public meetings act.” Present were Board members: Mr. Kelly, Vice Chair Reynolds, Mr. Pasola, Mr. Dixon, Mr. Davis Mr. McGee an Mr. Driber

2022-34 Salgado – 400 Carter – Requesting administrative Approval to Modify Condition #5 of Resolution 2012-18.
Tommy Turbiak and Carol Salgado sworn, explained the circumstances of why protocol wasn’t followed after approval of resolution. Carols son had handled the installation and she didn’t realize that anything was wrong until recent CO inspection. She believed everything was OK and permits had been secured.
Conditions
The Applicant must file for the requisite building permit within 120 days of the date of this Resolution.
All conditions of prior approval 2012-18 (other than Condition #5) remain in full force and effect unless specifically modified herein.

Davis and Carol Perl, applicants sworn, stated that they are the title owners of the subject property. The subject property is located in the SF5 zone. Single family residential homes are a permitted use in the zone.
There is an existing two-story single-family home on the subject property.
It is Applicant’s intent per the plans submitted to renovate the home covered deck/roof to improve the functionality and aesthetic appeal of the home.
Applicant proposes to construct a 4.5’ x 6’ one-story covered landing attached to the rear of the existing dwelling and extend the existing steps and patio to match the landing extension; and similarly revise the roof/covering over the extended landing as depicted on the plans.
The non-conformity for the extended landing to Baltimore Avenue is 20.5’ where 25’ is required; however, the existing dwelling is 10.1’ to Baltimore Avenue.
The photos presented depict the existing landscaping in this area and the extension proposed will not cause any impact to the surrounding neighborhood.
Applicant stated that the proposal satisfies the criteria for C(1) relief based upon the corner lot location on New Jersey Avenue and Baltimore Avenue; together with the existing dwelling and site improvements and that the proposal advances purposes of zoning as set forth in NJSA 40:55D-2 (a) and (i) – noting that the proposal provides for an aesthetic improvement to the site; a functional and safety improvement to the site; while the nonconformity creates no detriment to the public good.
Deliberations
Kelly – I think that they have done a reasonably good job. Setbacks are always a problem. You are making it more current – no problem
Davis – As an owner of an older home I understand wanting to improve it. I am in favor
Dixon: What you are doing is actually very nice.
Pasola: Beautiful home – being they promised to keep the old style I have no problem with it.
McGee – I have no problem with this
Driber – Good luck with it – it is gorgeous
Reynolds – We understand the hardship with corner lots – no detriment at all. In favor

2022-12 – Lisa Simpson – 104 Sanborn – Block 152; Lot 8 – Applicant wishes to install A/C condenser 15 inches off property line.
Lisa Simpson applicant, sworn, stated she is seeking a variance for moving her a/c units from the roof of the dwelling to the corner of her property. She did not get approval or permits to relocate or run the electric under the ground. Mr. Davis inquired why she cannot place them in a conforming location? They are a few conforming locations where it could be placed. Vice chair Reynolds inquired why they did not apply for a permit. A.J. Perri installed them without permits. The Board is not happy with location or the fact they were installed without permits. Ray Savacool also clarified that they would need to be elevated to meet flood compliance. Mr. Dixon is not pleased that the electric was run without permits; it is dangerous. Mr. McGee inquired who told her the roof was not a safe location? (The installer)
The applicant requested to be carried to have time to find another location for the a/c unit.
2022-14 – OutFront Media, LLC – 502 Sea Avenue – Block 12; Lot 25 – Applicant wishes to replace existing billboards with 2 – 35-foot-high LED billboards.
