MINUTES
The December 15, 2005 Regular meeting of the Board of Adjustment opened at 7:35 pm. The clerk read the notice of compliance with the "Open Public Meetings Act". Present were Board members: Mr. Simon, Mr. Wolfersberger, Mr. Struncius, Mr. Moberg, Mr. Cangelosi, Mrs. Tooker and Mr. Leonard Absent: Mr. Palisi
Motion by Mr. Leonard, second by Mr. Cangelosi to approve the minutes of December 1, 2005
Vote: Simon, Wolfersberger, Struncius, Moberg, Cangelosi, Tooker and Leonard..Yea
Motion by Mr. Leonard, second by Mr. Cangelosi to change the Regular meeting date from December 21, 2006 to December 7, 2006 and eliminate the special meeting for that month and to memorialize the meeting dates for 2006.

Application #2004-40 – The board has received a request from Elaine Petrillo to clarify where Denise Krieger’s a/c should be placed. The resolution clearly states that the a/c should be placed in the rear yard behind the fence line. Mrs. Krieger will need to renotice and appear before the board if she wants to place it somewhere else.
Application – 2004-17, James Barrett – The board discussed the letter submitted by Jim Barrett requesting an amendment to his previous resolution granting him relief in his front yard setback. It was determined by the board that he must renotice since it was not a previous mentioned variance.
Application #2005-31, National Sign Services, 1201-03 Richmond Avenue; Applicant wishes to remove existing free standing pylon sign and replace it with a new 63.61 sq. ft. pylon sign with an electronic message board.
Motion by Mr. Struncius, second by Mr. Leonard to carry application to the meeting of April 20, 2006 without notice.

Application #2005-35, 117B-119 Randall Avenue LLC c/o Jamie Paradise, Block 150, Lot 10; Applicant wishes to demolish two single family dwellings on one lot, sub-divide the property and construct two new single family dwellings.
It was the Board’s Engineers determination that the Planning Board should hear this application. Application was moved to the Planning Board.
Application #2005-12, First Baptist Church, 708 McLean Avenue, Block 203, Lot 25; Applicant wishes to construct a new building to provide the Church with classroom space in the lower level and a multi-purpose room with kitchen facilities in the upper level.
Motion by Mr. Wolfersberger, second by Mr. Leonard to carry application without notice to April 20, 2005.

Amend Application #2005-10 Bill Knapp, 100 Harvard Avenue, Block 132, Lot 1; Applicant wishes to construct single-family dwelling. (Side-yard variance, original application for 3rd floor habitable space denied)Steve Pardes, attorney for applicant. Amending previous denied application. Had originally noticed for variance but it got lost in the shuffle. Applicant is ready to go with new home but Building Department is requesting side yard setback. Corner lot is located on a paper street. Adequate distance from other properties. Home does not need any other variances. Introducing picture as A-2. Bill Knapp, sworn. Setback of old home was about 12 feet. It is the only variance needed. Not treated as an issue before because the Building Department did not request a variance. Mr. Wolfersberger requested to see the architecturals again to refresh his memory.
Deliberations:
Mr. Struncius: I just wanted to see the home again to make sure there was an aesthetic value. I think the setback is what it is against the paper street. In favor. Mr. Moberg: I also was looking at the aesthetics. The home due east has a 5-yard setback from the paper street. I am in favor. Can we request that if it is a high foundation that it is landscaped properly? We can phrase it as "Foundation Cover". Mr. Struncius: Also mention that the home will be covered with Cedar Impression Shakes and the architecture will be consistent with the drawings we have been shown.
Motion by Mr. Struncius, second by Mr. Leonard to approve application #2005-10 with conditions.

Application #2005-16,Nilsa Roth, 113 Atlantic Avenue; Block 63; Lot 7; Applicant wishes to add small gazebo type structure to front porch and in-ground swimming pool. Nilsa Roth, applicant, previously sworn. Requesting pool to be 5-feet off the fence, mechanicals to be placed behind garage. Question was on how new roofline would line up with existing porch. Picture entered as A-5. Moberg: We moved the pool and eliminated the variance. We approved mechanicals behind garage. What we were looking for was visuals. Lot coverage was to remain at 31.6%. Struncius: The porch is not passing the steps and will remain open. Cangelosi: Front yard setback will be? Struncius: 13.86 feet. Will the whole house be reroofed? Roth: Whole house. Timberline roof, all opened deck with white/natural railing.
Deliberations:
Struncius: Brought pool into conformity. Brought in nice representation, aesthetic improvement. We are increasing the non-conformity of the front yard setback, but this will be an open air and light porch. We can look favorably on the increase. Moberg: We are improving site lines of homes to the east and west. I congratulate the applicant for bringing back what we asked for. Leonard: I agree with Struncius and Moberg. In favor.
Motion by Mr. Struncius, second by Mr. Leonard to approve application #2005-16 with conditions.
