APRIL 8, 2021 SPECIAL MEETING
The April 8, 2021 special meeting of the Board of Adjustment opened at 7:00pm. The clerk read the notice of compliance with the “Open public meetings act.” Present were Board members: Mr. Kelly, Mr. Dixon, Vice chair Reynolds, Mr. Pasola, Secretary Schneider, Mr. Loder, Mr. McGee, Mr. Davis and Chairman Struncius (arrived for second application)
Also, present: Dennis Galvin, Ray Savacool and Karen Mills
Absent – Crasper and Villani
Memorialization of Minutes
Motion by Secretary Schneider, second by Mr. Kelly to memorialize the minutes of March 18, 2021 virtual meeting

Applications
2021-16 – Richard Tillson/Jackie Burke – 116 Philadelphia Avenue – Block 27; Lot 9 – Applicant lifted home – first floor lifted to accommodate garage. Bulk variances are pre-existing.
John Jackson, attorney for applicant. Power Point presentation entered as A-3. House was reconstructed after Sandy. Requesting relief for stairs and deck which became variances after the lift. Plans were signed off by previous construction official. Plans entered as A-4. There was some kind of disconnect – applicant believed everything was fine. The FEMA regulation just covered the lift, not the additional stairs and decking. House is exactly the same as previously submitted approved plans. The mistake was realized by the new official. Variance is now required for CO to be issued.
Thomas George Conley, sworn, credentials accepted, explained the situation.

Mr. Dixon inquired about the sidewalk ordinance. Ray Savacool stated that they would be subject to the pedestrian safety fund.
Michele Donato, land use attorney and Aunt of purchaser spoke.
Deliberations
Kelly – Looking at this house – it looks the same; a little more attractive and a little higher in the air. I have no problem with it.
Schneider – The house is not a huge house and not too high. Very nice job done by the builder.
Dixon – Agree with other members
Loder – Variances are deminimis – looking favorably on this application.
McGee – I agree – no issues with this application.
Davis – From a zoning view point this home is an improvement to the neighborhood.
Reynolds – agree with what has been said. Nice looking house – I have no problem with it.
Motion by Secretary Schneider, second by Mr. McGee to approve application #2021-16 of Richard Tillson/Jackie Burke – 116 Philadelphia Avenue – Block 27; Lot 9 –

2020-14 – Godwin Family Properties, LLC – 1 St. Louis Avenue – Block 174; Lot 1 – Applicant requesting to amend resolution.
Let the record reflect that Chairman Struncius is in attendance
Ray Bogan, attorney for the applicant. Ray Bogan explained the applicant is looking to amend prior approval. Albert Varosi, Professional Engineer explained the need to be in the Borough right-of-way. Mayor and Council have given approval by resolution to utilize the area in the right-of-way with zoning approval.

Mr. Dixon wants be assured the bollards will remain the same. (Yes)

Kelly – Concerned with establishments using the sidewalks.
Dixon – Have no issues with it as long as the bollards are in place for safety.
Schneider – well run family company – I have no issues
Reynolds – They run a good establishment – I have no issues
Loder – No issues

Struncius – I agree – with what we approved is represented. Nothing is bad – in favor
