The April 7, 2022 special meeting of the Board of Adjustment opened at 7:00pm. The clerk read the notice of compliance with the “Open public meetings act.” Present were Board members: Mr. Kelly, Mr. Dixon, Mr. Pasola, Secretary Schneider, Mr. Davis, Mr. McGee and Vice chair Reynolds

AGENDA
#2022-04 – Ralph/Paula Rosendahl – 416 Broadway – Block 161; lot 4.01 – applicant wishes to install an above ground pool. Impervious coverage proposed is 59% – reduced from 63% where 50% is allowed.
Applicant requesting to amend resolution to allow for a larger pool.
Ralph Von Rosendahl, sworn, explained the amendment request. He has realized that by reducing the impervious area by removing additional concrete he can have a large exercise spa. It is now 19 feet by 8 feet. The larger size will help with his wife’s therapy. It will conform to the pool setbacks. Impervious coverage is now 54.5% and is a net gain.
Deliberations
Kelly – Has no problem with this
Dixon – plus that we are reducing the impervious coverage; I do not like the redo. If the spa is reduced and the concrete removed, we would have been at about 50%.
Schneider – I have no problems with this.
Pasola – I like that we are reducing the impervious coverage: I have no problems either.
Davis – I also have no problems with the increase
Reynolds – Also have no issues

2022-13 – Ronald/Anne Marie Hammond (Hammond Family Trust) – 4 Broadway – Block – 121; Lot 28 – Applicant requesting relief from flood plain ordinance for crawl space. Would cause undue hardship while providing little or no benefit to the townships flood plain management.
Ronald and Anne Marie Hammond sworn, has owned the home since the 1970’2 and has never had a drop of water of any kind. Looking to upgrade the home. Not changing the footprint – just adding a dormer, which will allow a bathroom to be upgraded. Utilities will be moved out of the crawl space.

Deliberations
Kelly – The house looks like it is in pretty decent shape. Ordinance changes are for the good of the town. To repair these houses that you have to make some adjustments. I do not seem a problem with it.
Dixon – I am a little reluctant; to go against the ordinance about filling in the basement, but this is a little more of a unique situation where the house did not flood. As of tight now I would agree with the engineer and the Hammons. No problem with it.
Schneider – main concern is the safety. It has been there for 80 years and I have no problem with it.
Pasola – I agree with our engineer and with the conditions in place, I have no problem – I think it is a nice improvement.
Davis – We are certainly well seasoned in dealing with the floods and the amount of redo’s that have had to go on and in adjusting to the regulations. More and more houses are up where they should be. Your home is in a spot where you didn’t get hit. This particular application this is a good decision to get the utilities out of the crawl space and having the flood vents doesn’t hurt. I see no reason to object to the application.
McGee – It makes perfect sense. Utilities will be upstairs – in favor
Reynolds – I agree with a lot that has been said. The first floor is at the proper level and adding the flood vents will make it safer.

Maria/Robert Fumo, applicants, sworn, explained the improvements he would like to make to the garage. Robert Fumo explained that the garage is in need of upgrades. The masonry needs repair, garage walls and roof need replacement. The foundation will remain and the additional height will be used for storage. There will be electric but no plumbing. The storage will be accessed by pull down stairs and height will be less than seven feet. Dormer will be for adding light and added aesthetic.

Pasola – I agree with what has been said. I like the old look – it goes with the house

Reynolds – It has been there a long time – it is not moving – we are improving what is already there.
Condition
The attic space of the garage shall be accessed via pull down stairs and utilized solely for non-habitable storage space. There shall be no heating or air conditioning for the detached garage.
