The April 16, 2015 regular meeting of the Point Pleasant Beach Board of Adjustment opened at 7:30 pm. The clerk read the notice of compliance with the "Open Public Meetings Act. Present were regular members: Mr. Spader, Mr. Kelly, vice chair Reilly, Chairman Struncius, Mr. Reynolds, Mr. Davis and Mr. Ferguson

Michael Balmann, applicant, sworn, seeking variance to keep six (6) foot fence in his side yard.
Believes the fence looks better at six feet. Photo entered as A-3. Applicant believe that the fence adds an aesthetic value. The fence on the east side blocks partial view of the a/c unit/pool mechanicals.
Audience comments
Mary Faith Nugiel – 109 New Jersey Avenue – Back of applicants home extends past her home If you say no to him she can put up a six foot fence. She likes the six foot fence.
Deliberations
Spader – As much as he understands the reasoning he is looking at the right side and left side of the home as two different circumstances. If the neighbor fence gets denied then the gate side will have to be decrease to four feet.
Struncius – Does not believe that it is over stated. There is a balance to it. You need to have your own pool fence.
Reynolds – Believes the side with the equipment (east side) does keep the sound down.
Reilly – Has no problem with the east side. Does not see the need on the west side.
Ferguson – Believes the fence looks nice and is well done.
Motion by Mr. Spader, second by Vice Chair Reilly to approve application #2015-05 of 111 New Jersey Avenue LLC with conditions

1. If the neighbor to the west fence variance is denied the applicant will reduce the west side gate (fence) to 4 feet.

Application #2015-09 – Lisa/Michael Buldo – 131 Ocean Avenue Unit #3 – Block149; Lot 15.03 – Applicant installed air conditioner unit into rear wall of condo unit.
Lisa Buldo applicants, sworn. Joe Coronado, Jr. Esq attorney for applicant. Exhibits – Photos entered as A-3, 4 and 5. Photos taken in September of 2014. Air conditioner is located behind the tree and does stick out further than the bump out itself. Mr. Spader inquired why we are here. Lisa Buldo stated that she purchased the unit in October of 2013 and installed the unit and then realized that they needed a permit. Went to apply for the permit and was informed that they needed a variance.
Deliberations
Spader – Questions have been answered and didn’t know that you needed approval to put in an a/c.
Kelly – It is a construction feature and needed a permit – in favor
Reilly – It looks more like it is 3 feet off the property line and did not think it was a big deal quite frankly.
Reynolds – Same thing everyone else said – it is set back – in favor
Davis – it dots the I’s and crosses the t’s – in favor
Ferguson – It is not going to bother anyone – it is located in dead space – in favor
