ORDER PURSUANT TO THE DECLARATION OF DISASTER AND EMERGENCY TO ALL RESIDENTS AND PERSONS WITHIN THE BOROUGH OF POINT PLEASANT BEACH IN THE COUNTY OF OCEAN AND STATE OF NEW JERSEY

 

WHEREAS, pursuant to the powers vested by Chapter 251 of the laws of 1942, as amended and supplemented, N.J.S.A. App. A: 9-30, et seq., N.J.S.A. 40:48-1, et seq., and all applicable statutory law and regulations, the Borough of Point Pleasant Beach (“Borough”) declared on March 16, 2020, that a local disaster/emergency exists within by and through the required authorization of the Emergency Management Coordinator; and

 

WHEREAS, it is evident the Covid-19 pandemic has and will continue to have catastrophic consequences for the Borough’s small businesses and economy, including, but not limited to, the restaurants and their owners and employees located in the Borough; and

 

WHEREAS, the CDC and State of New Jersey have stated that social distancing guidelines and other health measures will continue to be required while the State relaxes the scope of the isolation orders and begins to reopen the economy; and

 

WHEREAS, in order to further protect the public health, welfare, and safety, support the seasonal economy and restaurants in their slow and difficult recovery, and support the Borough’s position as a premier summer destination for families, the Borough deems it necessary and compelling to authorize the expansion of temporary outdoor restaurant seating and serving areas for the summer 2020 season; and

 

WHEREAS, Governor Murphy issued Executive Order 183, which relaxed dining regulations allowing for 25% indoor dining; and

 

WHEREAS, 25% indoor dinning places a burden on restaurants to maintain financial stability without outdoor dining included; and

 

WHEREAS, The Borough of Point Pleasant Beach State of Emergency Amendment #5 pertaining to outdoor dining expires on October 1, 2020,

 

NOW, THEREFORE, I, Paul M. Kanitra, Mayor, Borough of Point Pleasant Beach and I, Guy Dempsey, Emergency Management Coordinator, Borough of Point Pleasant Beach here-by DECLARE the following:

  1. The emergency regulations set forth in The Borough of Point Pleasant Beach State of Emergency Amendment #5 are extended through November 30, 2020. The effective dates are subject to State Executive Orders and further Borough Orders. These emergency regulations cease when the OEM Coordinator declares the present State of Emergency has ended or expired.
  2. The use of outdoor heating equipment is inherently a fire/safety concern. Any installed heating equipment for outdoor dining must be inspected and approved by The Borough of Point Pleasant Beach Fire Subcode Official.

We will continue to work together with understanding and patience realizing that this event is continuously evolving and know that we the Mayor, Police Chief, OEM Coordinator and other Borough Officials are looking out for the overall health, safety, and welfare of all the residents and visitors of the Borough of Point Pleasant Beach.

This order shall take effect 6:00 a.m. September 23, 2020, and shall remain in effect, unless specifically stated, until such time it is determined by me an emergency no longer exists.
