ORDER PURSUANT TO THE DECLARATION OF DISASTER AND EMERGENCY TO ALL RESIDENTS AND PERSONS WITHIN THE BOROUGH OF POINT PLEASANT BEACH IN THE COUNTY OF OCEAN AND STATE OF NEW JERSEY

 

WHEREAS, pursuant to the powers vested by Chapter 251 of the laws of 1942, as amended and supplemented, N.J.S.A. App. A: 9-30, et seq., N.J.S.A. 40:48-1, et seq., and all applicable statutory law and regulations, the Borough of Point Pleasant Beach (“Borough”) declared on March 16, 2020, that a local disaster/emergency exists within by and through the required authorization of the Emergency Management Coordinator; and

 

WHEREAS, it is evident the Covid-19 pandemic has and will continue to have catastrophic consequences for the Borough’s small businesses and economy, including, but not limited to, the restaurants and their owners and employees located in the Borough; and

 

WHEREAS, the CDC and State of New Jersey have stated that social distancing guidelines and other health measures will continue to be required while the State relaxes the scope of the isolation orders and begins to reopen the economy; and

 

WHEREAS, in order to further protect the public health, welfare, and safety, support the seasonal economy and restaurants in their slow and difficult recovery, and support the Borough’s position as a premier summer destination for families, the Borough deems it necessary and compelling to authorize the expansion of temporary outdoor restaurant seating and serving areas for the summer 2020 season; and

 

WHEREAS, Governor Murphy issued Executive Order 183, which has relaxed indoor dining regulations.  This amendment will comply with the new regulations/guidelines issued by the governor.; and

 

NOW, THEREFORE, I, Paul M. Kanitra, Mayor, Borough of Point Pleasant Beach and I, Guy Dempsey, Emergency Management Coordinator, Borough of Point Pleasant Beach here-by DECLARE the following will go into effect September 4, 2020:

  1. Indoor dining in restaurants in the Borough of Point Pleasant Beach may resume on September 4,2020 at 6:00 am Eastern Daylight time in accordance with Governor Murphy’s executive Order 183 provided:
  2. The total number of patrons in indoor areas shall be no more than 25 percent of the food or beverage establishment’s indoor capacity, excluding the food or beverage establishment’s employees;
  3. All tables where individuals or groups are seated shall be six feet apart in all directions from any other table or seat and individual seats in any shared area that is not reserved for individual groups, such as an indoor bar area, are also six feet apart in all directions from any other table or seat;
  4. All indoor patrons are required to wear face coverings while inside the indoor premises of the food or beverage establishment. When seated at their table or their individual seat, indoor patrons shall wear face coverings until their food or drinks arrive, and after individuals have finished consuming their food or drinks, they shall put their face coverings back on. The face covering requirement does not apply if the patron has a medical reason for not wearing a face covering or is a child under two years of age;
  5. Food or beverage establishments shall only allow patrons to place orders for indoor table service when they are seated at a table or bar, and only wait staff or other employees may bring food or beverages to seated patrons;
  6. Patrons may only consume food or beverages while seated; no standing in bar areas of indoor dining facilities is permitted for any purpose; and
  7. All establishments must abide by all other health and safety standards issued by the Commissioner of DOH, including infection control practices and other sanitization protocols, consistent with her authority under the Emergency Health Powers Act.
  8. Effective at 6:00 a.m. Eastern Daylight time on September 4, 2020, entertainment centers where performances are viewed or given, including movie theaters, performing arts centers, and other concert venues, may open their indoor spaces to the public, subject to the following requirements:
  9. Limit the number of patrons in any indoor room where a performance is viewed or given to 25 percent of the stated maximum capacity, if applicable, at one time, excluding the entertainment business’s employees, but regardless of the capacity of the room, such limit shall never be larger than 150 persons;

 

We will continue to work together with understanding and patience realizing that this event is continuously evolving and know that we the Mayor, Police Chief, OEM Coordinator and other Borough Officials are looking out for the overall health, safety, and welfare of all the residents and visitors of the Borough of Point Pleasant Beach.

This order shall take effect 6:00 a.m. September 4, 2020, and shall remain in effect, unless specifically stated, until such time it is determined by me an emergency no longer exists.

ORDER PURSUANT TO THE DECLARATION OF DISASTER AND EMERGENCY TO ALL RESIDENTS AND PERSONS WITHIN THE BOROUGH OF POINT PLEASANT BEACH IN THE COUNTY OF OCEAN AND STATE OF NEW JERSEY

WHEREAS, pursuant to the powers vested by Chapter 251 of the laws of 1942, as amended and supplemented, N.J.S.A. App. A: 9-30, et seq., N.J.S.A. 40:48-1, et seq., and all applicable statutory law and regulations, the Borough of Point Pleasant Beach (“Borough”) declared on March 16, 2020, that a local disaster/emergency exists within by and through the required authorization of the Emergency Management Coordinator; and

WHEREAS, on March 16, the local State of Emergency, cancellation of all schools in conjunction with the Board of Education and Superintendent of Point Pleasant Beach; and

WHEREAS, on March 16, the local State of Emergency, closed of all bars, restaurants and gyms; and

WHEREAS, on April 5, the local State of Emergency, all playground equipment will remain closed, no team practices, or organized and non-organized sporting games; and

WHEREAS, on May 29, the local State of Emergency, closed rides, games and amusements and prohibited fireworks; and

NOW, THEREFORE, I, Paul M. Kanitra, Mayor, Borough of Point Pleasant Beach and I, Guy Dempsey, Emergency Management Coordinator, Borough of Point Pleasant Beach here-by DECLARE the following will go into effect immediately:

  1. Local emergency closure for schools is suspended as it is superseded by NJ Executive Order.
  2. Local emergency closure for gyms is suspended as it is superseded by NJ Executive Order.
  3. Bar and Restaurant opening/closure will be subject to changes governed by NJ Executive Order. Administrative procedures will remain under Amendment 5 of the Local State of Emergency.
  4. Team practices, organized and non -organized sporting games are now permitted following NJ Department of Health Guidelines.
  5. Athletic fields, parks, playground equipment, rides, games and amusements are now permitted, effective July 2, under NJ Executive Order. State mandated person to person contact and social distancing guidelines must be followed.
  6. Fireworks are now permitted pursuant to NJ Executive Order. Local ordinance and procedures will apply.
