ORDER PURSUANT TO THE DECLARATION OF DISASTER AND EMERGENCY TO ALL RESIDENTS AND PERSONS WITHIN THE BOROUGH OF POINT PLEASANT BEACH IN THE COUNTY OF OCEAN AND STATE OF NEW JERSEY
 
WHEREAS, New Jersey Governor’s Executive Order No. 107 states the CDC has recommended that individual’s practice “social distancing” to prevent community spread of the virus; and
WHEREAS, the CDC has defined social distancing as the practice of “remaining out of congregate settings, avoiding mass gatherings, and maintaining distance (approximately 6 feet or 2 meters) from others when possible”; and
WHEREAS, New Jersey Governor’s Executive Order No. 107 stated all recreational and entertainment businesses, including but not limited to the following, must close to the public as long as this Order remains in effect.  All places of public amusement, whether indoors or outdoors, including but not limited to, locations with amusement parks, water parks, aquariums, arcades, children’s play centers, family and children’s attractions; and
WHEREAS, pursuant to New Jersey Governor’s Executive Order No. 143, all public and private beaches and boardwalks in the State may be open to the public as long as these spaces are used and maintained consistent with the restrictions and recommendations imposed by executive orders; and
WHEREAS, pursuant to New Jersey Governor’s Executive Order No. 143 Prohibits impermissible gatherings of individuals, including special events such as festivals, concerts, fireworks, and movies, consistent with paragraph 5 of Executive Order No. 107 and paragraph 8 of Executive Order No. 142; and
WHEREAS, pursuant to New Jersey Governor’s Executive Order No. 107, All restaurants, dining establishments, with or without a liquor license, all bars, and all other holders of a liquor license with retail consumption privileges, are permitted to operate their normal business hours, but are limited to offering only food delivery and/or take-out services in accordance with their existing liquor licenses. If alcoholic beverages are to be sold from a restaurant, dining establishment or bar with a liquor license, such sales shall be limited to original containers sold from the principal public barroom. The on-premises consumption of alcohol is prohibited.  All retail sales of alcoholic beverages by limited brewery licensees, restricted brewery licensees, plenary and farm winery licensees (and associated salesrooms), craft distillery licensees and cidery and meadery licensees must be in original containers and must be sold through customer pick up and/or delivered by licensees in accordance with their existing licenses; and
WHEREAS, Borough of Point Pleasant Beach, State of Emergency, Amendment #4, prohibited on street parking in District 3 & 4 and closed public and private parking lots. The Inlet Parking Lot was opened with limited parking; and 
NOW, THEREFORE, I, Paul M. Kanitra, Mayor, Borough of Point Pleasant Beach and I, Guy Dempsey, Emergency Management Coordinator, Borough of Point Pleasant Beach here-by DECLARE the following will go into effect immediately:

  1. All Boardwalk and Beaches will open to the public with “social distancing” required.  Benches and chairs spaced under 6 feet apart shall be removed to facilitate 6-foot distancing.
  2. Restaurants may open for takeout  pursuant to Borough of Point Pleasant Beach State of Emergency Amendment #5.
  3. Rides, Games and Amusements will remain closed pursuant to the Governor’s Executive Orders.
  4. Special Events, fireworks, and concerts will remain prohibited.
  5. Effective immediately, private and public parking lot restrictions will be rescinded.
  6. On Friday, June 5th, Emergency Temporary No Parking restrictions will be rescinded.
  7. Effective immediately, the Inlet parking lot will be returned to normal operations.  Individuals must maintain a proper 6-foot distance at all times while fishing or conducting other activities.

We will continue to work together with understanding and patience realizing that this event is continuously evolving and know that we the Mayor, Police Chief, OEM Coordinator and other Borough Officials are looking out for the overall health, safety, and welfare of all the residents and visitors of the Borough of Point Pleasant Beach.
This order shall take effect immediately May 29, 2020, and shall remain in effect, unless specifically stated, until such time it is determined by me an emergency no longer exists.
